To provide SANBS with appropriate risk-based legal advice.
To ensure that SANBS litigation is managed efficiently and effectively.
To ensure that SANBS complies with relevant laws, standards, policies, and codes in their operations and dealings with stakeholders.
To provide ad hoc legal advice to SANBS, the Board, and its committees.
To keep abreast with and apprise SANBS on new laws as well as relevant case law.
To engage with relevant stakeholders on behalf of SANBS, including but not limited to regulators such as the Department of Health and the Medical Controls Council on regulatory matters.
To ensure that SANBS contracts with stakeholders are drafted and reviewed to minimize risk to SANBS.
To provide training to SANBS staff on relevant laws, codes, and standards.
To effectively manage the SANBS tip-off line.

- Legal Advice and Compliance
- Provide competent legal advice to SANBS, the Board, its committees, and donor structures.
- Ensure compliance with relevant laws, standards, policies, and codes in operations and stakeholder dealings.
- Stay updated on new laws, codes, standards, and relevant case law and inform SANBS accordingly.
- Engage with stakeholders, including regulators, on regulatory matters.
- Provide training on relevant legal and compliance topics.
- Undertake legal research, source specialist advice, and prepare legal opinions.
- Litigation Management and Dispute Resolution
- Identify and assess litigation risks.
- Manage litigation processes and explore alternative dispute resolution mechanisms.
- Coordinate with legal counsel, draft and review legal documents, and monitor litigation matters.
- Negotiate settlements and legal costs.
- Address audit findings related to legal matters.
- Draft and Review Contracts
- Negotiate, draft, and review contracts to protect SANBS interests.
- Ensure contracts are compliant with legislation and policies.
- Sign off on contracts.
- Commercial Contract Management
- Oversee contract management operations.
- Manage the Contract Management team.
- Ensure timely signing and proper record-keeping of contracts.
- Provide regular updates on contract status.
- Lease Agreement Management
- Review lease agreements and maintain the lease register.
- Ensure effective lease operations across zones.
- Report on lease agreements periodically.
- Research Study and Project Agreements Management
- Review research and project agreements and registers.
- Manage these agreements effectively.
- Report on research and project agreements periodically.
- Management of SANBS Tip-off Lines
- Manage tip-off notifications in accordance with policy.
- Review related policies and coordinate investigations.
- Update case management systems and report periodically.
- Additional Responsibilities
- Manage SANBS insurance portfolio.
- Provide legal training to staff and stakeholders.
- Ensure statutory documents are up to date.
- Adhere to corporate governance standards, including King IV.
- Attend to other instructions from the Company Secretary.
Education and Experience:
- Admission as an attorney/advocate is advantageous.
- Minimum requirements in experience and knowledge to be specified.
