Role Overview:

The Legal Counsel – Commercial Law & Foreign Markets will provide expert legal support and strategic guidance to the business, ensuring compliance with international commercial laws and facilitating operations across multiple jurisdictions.

Key Responsibilities:
  1. Draft, review, and negotiate licences for nurseries, commercial growers, and trial growers.
  2. Negotiate and finalise commercial contracts with global suppliers and customers.
  3. Assess supplier and customer contracts, ensuring alignment with business objectives, and provide guidance on contractual obligations and risk management strategies.
  4. Research and interpret relevant laws in new operating regions.
  5. Develop and implement grower licences in new jurisdictions.
  6. Manage the execution of licences and contracts to support supply chain operations.
  7. Advise on legal considerations for establishing and maintaining fresh produce supply chains.
  8. Identify and interpret laws regulating fresh produce supply in South Africa, North Africa, and Europe.
  9. Ensure legal and regulatory compliance across regions.
  10. Provide proactive legal guidance to mitigate risks related to compliance.
  11. Support global litigation cases by reviewing pleadings, preparing discovery, and conducting legal research.
  12. Assist with legal challenges in North Africa and Europe, including customs clearance issues.
  13. Advise on corporate law matters and corporate structures in South Africa.
  14. Liaise with external legal counsel as needed.
Qualifications & Experience:
  • LLB degree or equivalent; admission as an attorney/advocate.
  • 8-10 years of legal experience, preferably in international trade, agriculture, or FMCG industries.
  • Experience with intellectual property, licensing, and foreign market regulations.
  • Knowledge of South African corporate and regulatory compliance.
