Job description

Purpose of the Job

The purpose of the role is to assist INSETA on all matters relating to legal compliance and contract management functions.

Key Performance Areas
  1. Legal Advice and Opinions (30%)
    Contribute to the successful implementation of the INSETA Excellence model. Provide opinions, advice, and interpretation of new legislation and regulations.
  2. Contract Management (10%)
    Assist with drafting, vetting, reviewing, negotiating, and re-negotiating legal agreements, including service level, intermediary, binder, outsource agreements, and other legal documentation. Conduct research and develop proposals on strategic initiatives. Implement and maintain an effective contract management system. Develop procedures for contract termination and ceding as required.
  3. Compliance with Statutory Requirements (20%)
    Respond to regulatory information requests accurately and timely. Review INSETA's legislative objectives and assess gaps in legal frameworks. Contribute to strategy, planning, and reporting. Coordinate with external legal counsel on litigation strategies. Prepare briefs and recommend remedies. Identify and deliver relevant legal training to staff. Develop projects to ensure regulatory compliance.
  4. Organisational Litigation
    Review litigation documents, draft opinions, and provide legal advice to protect INSETA's interests. Offer legal opinions and advice on litigation matters.
  5. Governance and Reporting
    Review Board presentations for legislative conflicts. Advise on governance matters, including the Companies Act and King IV. Support the CEO with Board and external meetings. Engage external attorneys and prepare briefs. Develop and review Dispute Resolution Frameworks. Prepare governance reports.
  6. Risk Management
    Work with risk management to review the Regulatory Universe and develop Compliance Risk Management Plans. Implement action plans from the legal operational Risk Register.
  7. Financial Support
    Assist in managing the Legal Department's budget and resources, ensuring compliance with policies and the Public Finance Management Act.
Qualifications and Experience
  • Minimum Requirements: Grade 12 or equivalent, LLB (NQF 8), admitted attorney of the High Court of South Africa.
  • Experience: At least 5 years providing legal services, including litigation, contract management, or regulatory compliance, with 2 years in a regulatory environment and 2 years post-admission experience.
Knowledge and Skills
  • Strong understanding of legislations governing SETAs, corporate law, contract law, and administrative law.
  • Proven experience in legal counsel, litigation, contract drafting, and vetting.
  • Knowledge of Public Financial Management Act (PFMA), National Treasury regulations, and other relevant legislation.
  • Excellent legal interpretation, analytical, negotiation, and drafting skills.
  • Strong communication, research, presentation skills, and high confidentiality.
  • Ability to prioritize, innovate, and work within strict deadlines.
