Job description

Job Summary :

Represents insureds and the Company in the defense of bodily injury and property damage lawsuits, subrogation, and Allstate Financial cases. Prepares for and conducts hearings, trials, arbitrations, mediations, and depositions. Prepares and argues pre- and post-trial motions. Assists colleagues in resolving calendar conflicts. Provides counsel to business clients on day-to-day issues. Monitors and reviews new laws, regulations, and case law; identifies and summarizes relevant issues; collaborates with other areas of the L&R department; proactively provides advice and counsel to the business unit on the impact of new laws on the business. Monitors counsel.

Key Responsibilities :

  • Investigate and pursue subrogation litigation as appropriate.
  • Contact third-party carriers to negotiate and resolve auto and property subrogation cases.
  • Review new file assignments and approve initial pleadings, propound discovery, and develop strategy.
  • Contact clients to discuss their cases and answer questions. Maintain contact at a minimum of 90 days.
  • Coordinate with claims on litigation plans, recurring contacts, strategy conferences, etc.
  • Review all documentary evidence.
  • Prepare witnesses and clients for depositions, arbitrations, mediations, and trials, including expert witnesses.
  • Conduct depositions and prepare summary documents.
  • Prepare and conduct court appearances (e.g., matter management conferences, hearings, status conferences).
  • Conduct settlement/dispositive proceedings (e.g., mediations, arbitrations).
  • Try and/or arbitrate cases and prepare motions in limine and summary documents.
  • Draft post-trial motions.
  • Manage projects.

Supervisory Responsibilities :

This job does not have supervisory duties.

Knowledge / Skills / Abilities / Experience :

  • Juris Doctorate degree and member in good standing of the TX State Bar.
  • Two to four years of experience in Subrogation, Collections, Insurance Defense, and/or Personal Injury litigation.
  • Trial and/or arbitration experience preferred, with flexibility to work across disciplines including Subrogation, SIU, and UM.
  • Computer skills required; experience with Microsoft Office, Lexis, and internet research.
  • Ability to work well with others in a team of attorneys, paralegals, and administrative staff, supervised by Lead Counsel.
  • Must handle a large caseload effectively.
  • Excellent verbal, written, and interpersonal skills for working with internal and external contacts, preparing reports, pleadings, and correspondence, and collaborating effectively.
  • Ability to travel as needed.
