This position is eligible for telework to applicants who reside in Minnesota or a bordering state. Effective June 1, employees living within 50 miles of the office location listed above will be required to work in the office at least 50% of the time each month. For those who live 50 or more miles away, with supervisory approval and satisfactory performance are eligible to telework up to 100% of the time.

This position provides legal advice and analysis, management and expertise for the Department’s compliance objectives and daily activity within the DHS Health Care Integrity & Accountability (HCIA) Division. This position serves as a legal and technical expert for HCIA activities, with a particular focus on the Tort Recovery Unit (TRU), providing subject matter expertise, advice and analysis regarding Minn. Stat.

  • 176.191 and 256B.042, and related federal and state law and policy.

The Staff Attorney:

  • Acts as a resource and legal subject matter expert to educate and provide guidance to various county attorneys, private attorneys and tribes regarding policy and administration of the Division’s recovery activities. Provides legal advice and analysis on issues related to MA tort recovery program to the agency.
  • Serves as the legal expert in the subrogation and lien areas of TRU. Advise and educate workers’ compensation and personal injury attorneys on Medicaid, subrogation, third-party liability and other public benefits for the Tort Recovery Unit (TRU).
  • Files liens, interventions, assignments and other claims for the reimbursement of MA, GA, and MFIP funds from liable third parties.
  • Represents the agency in mediation, settlement conferences and administrative hearings.
  • Educates and trains the private bar, MCOs, and other legal partners regarding Medicaid and Subrogation. Creates legal/educational resources related to the Medicaid program, targeted to and for the purpose of educating private and public attorneys whose work, representation and practice touch our programs; including but not limited to workers’ compensation and personal injury attorneys. Is a liaison and subject matter experts for these stakeholders within DHS.
  • Has delegated authority to negotiate and settle state and national litigation on behalf of the agency for workers’ compensation, personal injury, liability, auto, mass tort, class action, etc. Has delegated authority to execute settlement documents for the agency.
  • Develops and analyzes legislation and legislative reports/studies related to the Unit’s programs and provides support for overall Benefit Recovery Section legislative activities. Analyzes and presents legislative proposals and initiatives and responds to legislative proposals from external sources, as assigned by HCIA leadership.
  • Serves as a compliance and change agent as HCIA works toward system modernization, including process analysis, documentation, and process improvement, in collaboration with division leadership.

Minimum Qualifications

  • JD degree from an ABA accredited law school
  • Current license and in good standing to practice law in Minnesota
  • At least three (3) years’ experience as a practicing attorney in an area of law related to the position.

Experience must demonstrate the following:

  • Expertise in Federal and state laws, regulations, and case law relating to Workers Compensation and/or Personal Injury.
  • Knowledge of data practices laws and requirements.
  • Advanced legal research and writing skills.

Preferred Qualifications

  • Variety of experiences working effectively with others from different backgrounds and cultures
  • Communicate with a variety of professional and lay persons complex legal topics; identify, articulate, analyze, and resolve complex problems having short and long term implications
  • Litigation experience
  • Knowledge of Minnesota’s legislative processes, document formats, and accepted procedures for introducing and supporting proposed legislation
  • Ability to assess the implications of proposed health care reforms regarding recovery at federal and state levels as it relates to and has impact on recovery policy in Minnesota
  • Knowledge of State and local government structure and organization, and understanding of state supervised, county administered human services programming
  • Ability to make clear and sound recommendations to Division leaders who depend on accurate, objective, insightful and timely analyses and recommendations.
  • Ability to manage multiple concurrent projects and competing priorities under demanding deadlines.
