Qualifications

  • Must be admitted to practice law and in good standing in the Commonwealth of Kentucky or comply with SCR rules.

Responsibilities

  • Assist in drafting KSP responses to Open Records Act requests and provide legal counsel on ORA issues.
  • Represent the agency and Troopers in state and federal court, drafting responses and motions.
  • Assist with subpoenas for agency records and review documents and media to meet deadlines.
  • Represent the agency in employee grievances before the Personnel Board as needed.
  • Conduct complex legal research and provide opinions to Command Staff.
  • Instruct cadets and provide training on current legal issues.
  • Perform other duties as assigned.

Description

Kentucky State Police is the premier, full-service law enforcement agency in the Commonwealth of Kentucky.With the highest level of professionalism and integrity the Kentucky State Police works to prevent, reduce anddeter crime and the fear of crime, enhance highway safety through education and enforcement, and safeguardproperty and protect individual rights.

Provides a variety of complex legal services for the Office of Legal Services, Justice and Public SafetyCabinet, which are occasionally characterized by issues which are unique, controversial or technical in natureand require extensive research and analysis.

Responsibilities include but are not limited to the following:

  • Assist in drafting KSP responses to Open Records Act (ORA) requests, including reviewing, editing, andfacilitating approval of such responses; provide legal counsel to KSP's custodian of records related to issuesarising under the ORA; and handle KSP ORA appeals filed with Office of the Attorney General and circuit andappellate court actions arising under the ORA on behalf of KSP.
  • Represents the agency and Troopers in their individual capacity in state and federal court involvingcomplex complaints and other claims by drafting responses, filing discovery, pleadings and motions andappearing in court on their behalf and on behalf of the General Counsel as needed.
  • Assists paralegal in complying with all issued subpoenas for agency records, including reviewing alldocuments, video and audio files by the deadlines.
  • Represents the agency when Chapter 18A employees file grievances or complaints against the agency beforethe Personnel Board.
  • Conducts complex legal research and analysis of issues related to litigation, as well as issues unique tothe Department of Kentucky State Police in order to provide legal opinions to Command Staff.
  • Instruct KSP cadets during legal blocks at the academy and in-service training for sworn troopers oncurrent legal issues.
  • Perform other duties as assigned

EXPERIENCE, TRAINING, OR SKILLS: Must have two years experience as a licensed attorney in the practice of law.

Substitute EDUCATION for EXPERIENCE: A Master of Laws degree (LL.M.) will substitute for one year of the required experience.

SPECIAL REQUIREMENTS (AGE, LICENSURE, REGULATION, ETC.): Must be admitted to practice law and in good standing in the Commonwealth of Kentucky OR comply with Kentucky Supreme Court Rule (SCR) 2.111 (limited certification of admission to practice), SCR 2.112 (attorney participants in defender or legal services programs), SCR 2.117 (practice pending admission). Must maintain any required licensure(s), certification(s), or other credentials for the length of employment in this job classification. Employing agency is responsible for ensuring employee possesses and maintains required licensure(s), certification(s), or other credentials.

Working Conditions

Duties are performed primarily in both office and courtroom settings. Travel is required.

Probationary Period

This job has an initial and promotional probationary period of 6 months, except as provided in KRS 18A.111.
