The Civil Enforcement Division will consider applications from attorneys with prosecutorial experience seeking to expand their skills.
The Office of the New York State Attorney General’s (OAG) Medicaid Fraud Control Unit seeks an experienced litigator to serve as a Special Assistant Attorney General in its Civil Enforcement Division, primarily based in New York City. The attorney will lead complex civil fraud investigations in the healthcare industry and litigate such matters in federal and state courts.
The Medicaid program provides health coverage to millions of New Yorkers, including low-income persons, children, elderly adults, and people with developmental disabilities. MFCU is the nation’s leading law enforcement agency ensuring the financial integrity of New York’s $96 billion Medicaid program by investigating healthcare providers involved in billing schemes that harm Medicaid recipients and cause financial loss to the state. MFCU also investigates abuse and neglect in nursing homes and residential health care facilities.
With civil and criminal enforcement powers, MFCU uses various laws to bring actions, including asset forfeiture. Many investigations involve coordination with federal, state, or local agencies, resulting in criminal convictions and recovery of taxpayer funds.
Recent highlights include reports on nursing home neglect during COVID-19, lawsuits against nursing homes like Centers Health Care, Cold Spring Hills, The Villages of Orleans, and Fulton Commons, and recoveries such as $26.8 million from Mallinckrodt, nearly $7 million from home health agencies, and $22.7 million from a pharmaceutical company for kickback schemes.
Qualifications:
Applicants must reside in or plan to move to New York and be admitted to practice in New York. U.S. citizenship is required. A two-year commitment is expected.
