Job summary

Utilities Solutions Company is seeking a Senior Counsel Regulatory & Development to lead regulatory strategy for electric transmission assets. You will develop filings for FERC and NY PSC, interpret regulatory orders, and advise senior leadership on compliance and rate matters.

The role requires 5+ years in regulatory law, NY licensure or eligibility, and strong communication and project management skills. Onsite position with direct hire employment.

Qualifications

• JD from an accredited law school.
• Licensed to practice in New York, or eligible to become registered in-house counsel in NY within 6 months.
• Minimum of 5 years of legal experience with regulatory focus.

Responsibilities

• Lead the Company’s Regulatory Strategy from construction through operation of electric transmission assets.
• Develop and submit regulatory filings to FERC, NY PSC, and other bodies.
• Monitor and advise on TO tariffs, ISO/RTO tariffs, and applicable laws.
• Support matters before FERC, NY PSC, and NYISO including ratemaking and compliance.
• Assist with cost recovery filings and advocacy for just and reasonable rates.
• Ensure regulatory and legal compliance across the company and manage external regulatory counsel.

  • Licensed to practice in New York, or licensed in another jurisdiction and capable of becoming licensed or qualified as registered in-house counsel in New York within six (6) months of employment.

Responsibilities:

• Lead the Company’s Regulatory Strategy
  • Serve as key legal advisor for all regulatory matters from construction through operation of the company’s electric transmission assets.
  • Develop and submit regulatory filings to the Federal Energy Regulatory Commission ("FERC"), the New York Public Service Commission ("NY PSC"), and other regulatory bodies, as needed.
  • Monitor, interpret, and advise on matters stemming from agreements with transmission owners ("TO"), relevant TO tariffs, Independent System Operator ("ISO") / Regional Transmission Organization ("RTO") tariffs, and applicable laws, regulations, and orders.
  • Support in matters before the FERC, NY PSC, and the New York ISO ("NYISO"), including ratemaking, comment drafting, administrative proceedings, and compliance affairs.
  • Assist with developing, analyzing, and presenting cost recovery filings before regulatory bodies, including advocating for just and reasonable rates and incentive treatment.
  • Ensure the company remains in compliance with all applicable regulatory and legal requirements.
  • Oversee and manage external regulatory counsel.
• Support the Development of New Projects & Opportunities
  • Lead regulatory strategy for new development opportunities for the company, including NYISO Public Policy Transmission Need ("PPTN") projects.
  • Assist with developing Article VIII applications ("Siting of Renewable Energy and Electric Transmission"), and additional permitting as required from federal, state, and municipal authorities.
  • Provide legal support throughout the interconnection process, including for projects being developed by the company which will connect to the facilities of others, and for projects developed by others which are either requesting interconnection to the company’s facilities, or which will otherwise result in impacts to the company’s facilities.
• Protect and Advance the Company’s Interests
  • Identify and analyze legal challenges and present logically sound legal recommendations that demonstrate a comprehensive understanding of business objectives and limitations.
  • Assist with leading the response to potential litigation and develop well-reasoned recommendations for handling legal disputes between various parties.
  • Perform thorough legal due diligence to evaluate potential risks and liabilities associated with the company’s development pursuits.
  • Develop comprehensive legal risk mitigation strategies to minimize potential legal challenges and protect the company’s interests.
  • Stay abreast of new laws, legal decisions, and legislative actions that impact the company and advise on their implications.
