Bernhardt Riley, Attorneys at Law is a boutique firm in New Mexico seeking a Debt Defense Litigation Attorney to manage a high-volume consumer debt caseload from appearance through trial. The position is fully remote, with occasional in-person court appearances in New Mexico.

The ideal candidate will quickly evaluate lawsuits, identify leverage, and develop defense and settlement strategies while advancing client objectives and firm improvement efforts.

Qualifications

• Active New Mexico Bar license in good standing
• Minimum three years of meaningful experience handling consumer debt litigation
• Experience drafting and arguing motions
• Experience handling written discovery and discovery disputes
• Excellent legal research, writing, and analytical skills
• Ability to independently evaluate cases and develop litigation strategies
• Ability to manage disputes through settlement, mediation, arbitration, or trial
• Strong client-facing communication skills
• Ability to effectively manage an active caseload in a remote environment

Responsibilities

• Manage consumer debt defense matters from initial appearance through resolution, including cases involving credit cards, consumer loans, debt buyers, and other consumer debt claims
• Develop a case-specific defense and resolution strategy and manage matters from notice through settlement, dismissal, summary judgment, mediation, or trial
• Draft and respond to written discovery and prepare and argue motions to dismiss or for summary judgment
• Attend Zoom/remote hearings and in-person proceedings when necessary; coordinate with support staff
• Negotiate strategically with opposing counsel and provide clients with clear litigation recommendations
• Lead and mentor team members within a remote Debt Defense Division
