OTDA is seeking Hearing Officers to preside over impartial hearings for applicants and recipients of New York State social services programs. Candidates may be hired non-competitively under NY HELPS with qualifications including NYS Bar admission or equivalent legal experience.

Full-time permanent appointments are expected; travel to various locations statewide is required. Telecommuting up to 50% may be available in accordance with OTDA policies.

Qualifications

• 12 months as an Assistant Hearing Officer or admission to the NYS Bar with 24 months of legal experience in trial-like proceedings
• Law school graduation and/or eligibility for NYS Bar Admission
• Admission to NYS Bar required for certain positions

Responsabilités

• Review requests for hearings and determine issues and applicable regulations
• Direct witnesses and production of records and documents
• Manage hearing calendars to ensure timely decisions
• Conduct hearings and review appeals on benefits and related issues
• Instruct parties on rights and ensure fairness and due process
• Administer oaths and eliciting testimony
• Rule on objections, relevancy, and admissibility of evidence
• Organize records and enter admissible exhibits into the record
• Maintain a record of the hearing proceeding
• Apply laws and policies to the facts and evidence
• Conduct legal research to prepare for hearings and determine conclusions
• Draft written opinions and decisions; issue final decisions when required
• Recommend acceptance or rejection of claims or settlements
• Explain appeal options to parties
• Review new legislation and court decisions affecting hearings
• Assist in defending lawsuits and drafting briefs
