Job description

Join the Office of the Attorney General’s (OAG) Child Support Division (CSD) in our mission to encourage responsible parenting by promoting the involvement of both parents in their children’s lives and ensuring that children in Texas receive the support they need and deserve.

The Special Litigator performs highly complex (senior-level) legal work. Work involves representing the state’s interest in judicial and administrative matters, and providing legal advice, consultation, and technical assistance to the Child Support Program and staff. CSD AAGs are part of a collegial statewide team dedicated to supporting Texas children and families. AAGs experience the challenge and honor of public service while enjoying a healthy work-life balance, developing hands-on legal experience, and engaging in camaraderie with colleagues across the state.

This position may be based in any Texas city with an OAG Child Support Division office. Regardless of primary physical office location, the candidate must collaborate with relevant stakeholders throughout the state. Some travel to and from El Paso and other worksites throughout the state for in-person meetings will be necessary.

Key Responsibilities:
  1. Represent the State of Texas at legal proceedings related to child support and medical support, including locating, establishing, enforcing, modifying, or terminating court orders.
  2. Provide legal advice, consultation, and technical assistance to the Child Support Program, including researching legal issues, preparing responses to discovery, trial briefs, and memoranda on complex cases.
  3. Handle civil litigation, such as probate, tax, foreclosure suits, and personal injury claims.
  4. Review and approve employer enforcement submissions, assist with case preparation, and represent the Office at enforcement hearings.
  5. Review and approve administrative license suspension cases and represent the Office in license suspension hearings.
  6. Review criminal non-support submissions and act as a liaison with the District Attorney, including prosecution.
  7. Assist in planning the annual Statewide Assistant Attorneys’ General Conference.
  8. Participate in workgroups, conferences, and meetings, delivering presentations on IV-D legal or practice issues.
  9. Develop and deliver training for Child Support staff related to Special Litigation functions.
  10. Perform related work as assigned, maintain relevant knowledge, and ensure confidentiality and security of sensitive information.
Minimum Qualifications:
  • Graduation from an accredited law school with a Juris Doctor (J.D.) degree.
  • Four years of full-time legal experience, including two in Family Law.
  • Licensed attorney in Texas, in good standing with the State Bar of Texas.
  • Knowledge of Family Law and the Texas Family Code.
  • Skills in legal writing, mediation, negotiation, trial advocacy, legal research, and effective communication.
  • Ability to handle multiple tasks, prioritize, and meet deadlines.
  • Ability to work cooperatively, provide excellent customer service, and work in person at the designated OAG location.
  • Willingness to travel as needed, including overnight stays.
Preferred Qualifications:
  • Experience with Texas Child Support Program, probate law, jury trials, high-volume legal practice.
  • Proficiency in reading, writing, and speaking Spanish.

Additional requirements include the ability to lift 30 lbs and work more than 40 hours per week as needed, in compliance with FLSA.
