Summary

The Mitigator III manages mortgage modification program cases from intake through final resolution. This role gathers and validates borrower and case information, prepares and reviews loss mitigation submissions, administers Portal activity and deadlines, facilitates communications and conferences, documents compliance, prepares required reports and court filings, and maintains complete and confidential case records. The Mitigator III serves as a knowledgeable, neutral point of coordination for borrowers, counsel, creditors and servicers, trustees, and the Court, while training and supporting team members in established procedures.

Essential Duties and Responsibilities

1. Manage assigned mortgage modification program matters from intake and case setup through final resolution.

2. Schedule and conduct client interviews; gather and validate required bankruptcy, household, employment, income, expense, and mortgage information; and assist with applications, questionnaires, and forms.

3. Review data and supporting documentation for completeness, accuracy, and currency, and promptly resolve missing, stale, inconsistent, or incorrect information.

4. Prepare, assemble, and quality-control Initial MMP Packages and other loss mitigation submissions; upload documentation through the Portal; and coordinate required notices and court filings.

5. Apply MMP rules, procedures, forms, deadlines, participant responsibilities, creditor documentation requirements, and available loss mitigation options when guiding participants and administering cases.

6. Support access to and use of the Court-approved Portal and Document Preparation System, troubleshoot workflow questions, and create or update user guides and support materials.

7. Monitor Portal communications, case activity, participant obligations, and case-specific deadlines, taking appropriate action to keep each matter progressing toward a decision.

8. Prepare for, schedule, and conduct MMP conferences as needed; coordinate with parties and counsel; issue required advance notice; and document conference activity in the Portal.

9. Identify and objectively document non-compliance, preserve supporting evidence, prepare required certificates and reports for Court review, and escalate delays, unresolved disputes, or failures to prosecute.

10. Monitor trial loan modifications through execution of a final modification or denial, maintaining appropriate Portal access and case oversight throughout the trial period.

11. Maintain complete and confidential case notes, ECF updates, status records, reports, correspondence, and other program documentation; coordinate with approved outside professionals when directed.

12. Train, coach, and supervise team members on assigned procedures, quality standards, and workflows, and maintain supporting process and training documentation.

13. Work independently, manage a high-volume caseload and competing deadlines, support required operating coverage, and complete assigned projects and operational reporting.

Education and/or Work Experience Requirements
  • Professional experience working with attorneys, courts, creditors and servicers, trustees, customers, and other stakeholders.
  • Mortgage loss mitigation knowledge is essential; prior experience as a Loss Mitigation Specialist is preferred.
  • Bankruptcy, legal support, court-program, mediation-program, paralegal, or comparable regulated case-administration experience is strongly preferred.
  • Demonstrated experience managing deadlines, case workflows, document exchanges, quality-control review, and electronic court filing or docket-review processes, including ECF/PACER-related workflows.
Knowledge, Skills, and Competencies
  • Advanced knowledge of mortgage loss mitigation, including loan modification, refinance, forbearance, short sale, surrender, mortgage financial instruments, income validation, documentation requirements, and program eligibility terms.
  • Working knowledge of Chapter 13 bankruptcy and MMP procedures, with the ability to interpret and follow Court orders, local procedures, deadlines, and required forms.
  • Ability to remain neutral, professional, and process-focused while communicating procedural requirements clearly to consumers, attorneys, creditors and servicers, trustees, and the Court.
  • Exceptional case-management skills, including deadline tracking, documentation control, quality assurance, issue escalation, and management of a high-volume caseload.
  • Strong judgment and attention to detail, including the ability to identify non-compliance, document facts objectively, and prepare accurate court-facing reports and compliance documentation.
  • Proficiency with Microsoft Office, Adobe Acrobat or equivalent PDF software, electronic document management, the Portal, and related case-management systems.
