Major, Lindsey & Africa’s Interim Legal Talent group has an immediate need for a Temporary Advertising and Marketing Counsel
Overview: Major, Lindsey & Africa is seeking an Attorney with 5-8+ years of experience in Advertising Trademark and Copyright Review.
Company: A Healthcare Marketing Agency
Experience: At least 5-8+ years of Attorney experience in Advertising with Trademark and Copyright Review experience as well as Commercial Contracts.
Location: REMOTE. East Coast or Central Time Zone Preferred. NYC is a plus.
Responsibilities Include:

  • Provide counsel regarding the planning, buying, and placement of traditional, mobile, social, and digital media, as well as the execution of digital marketing and custom content integration programs and experiential planning and activation.
  • Negotiate and draft a wide variety of agreements, including client and supplier agreements, media placement and sponsorship agreements, technology services agreements, and data/intellectual property licenses.
  • Provide legal counsel on an ongoing basis concerning marketing in traditional and new media, by addressing issues pertaining to advertising law, rights of privacy and publicity, user-generated content, social media, brand integration, and media/marketing campaign tracking and measurement.
  • Collaborate closely with privacy counsel regarding online behavioral advertising and data management issues related to various media and marketing offerings.
  • Educate, advise, and counsel management on legal issues affecting business decisions.
  • Standardize templates, processes, and legal guidance where possible, to improve efficiency of legal services to business units.
  • Provide periodic training to business units on key legal issues affecting operations.

Qualifications
  • JD degree from an ABA accredited law school
  • Admitted to practice and in good standing in New York (or if admitted to practice and in good standing in another State, the ability to qualify immediately for In-House Counsel Registration in New York)
  • Excellent writing, oral communication, analytical, time-management and organizational skills
  • Significant contract negotiation and drafting experience
  • Detailed working knowledge and experience negotiating, drafting and managing compliance with talent agreements including for performers and social media influencers
  • Experience negotiating and drafting all production-related services agreements such as location and facility agreements and supplier contracts
  • Knowledge of guild and union agreements and laws and regulations governing advertising creation and distribution, including Federal Trade Commission guidelines and policies, particularly as governing Native Advertising and Endorsements & Testimonials
  • Proven ability to use strategic thinking and excellent business judgment to provide practical legal advice to senior management
  • Exceptional customer service and interpersonal skills
  • Proven ability to understand business objectives and applicable risks/rewards
  • Results-oriented with outstanding attention to detail
  • Ability to work effectively in a fast-moving, challenging, and constantly changing environment
  • Ability to work both independently and collaboratively
  • Proven ability to manage high volume of competing priorities simultaneously
  • Efficient in the use of Microsoft Office and other software commonly used in the legal and advertising industries


Pay Range: $90-100/hour
