Job summary

The WV Offices of the Insurance Commissioner seeks a General Counsel to provide legal guidance to the executive team and agency staff on statutes, rules, and regulations affecting insurance in West Virginia.

The role involves advanced legal research, drafting briefs, bills, and rules, and representing the agency before the Legislature. Experience in administrative or judicial proceedings is required, with nine years of related work and WV bar admission.

Qualifications

• Admission to practice law in the State of West Virginia.
• Nine years of full-time or equivalent paid experience in the practice of law, including trial experience in administrative or judicial proceedings.
• Substitution: One year of full-time or equivalent paid employment as an attorney with the agency can count as two years of other qualifying experience.

Responsibilities

• Serve as General Counsel for the agency and provide legal advice to the executive team and others on statutes, rules, and regulations.
• Perform advanced legal research, prepare memorandums and briefs on complex insurance issues, draft bills and rules.
• Analyze and summarize laws from other states related to insurance issues pending West Virginia.
• Represent the agency in matters before the Legislature and testify before committees; collaborate with committee counsel.
• Correspond with legislators and the public as needed.
• Manage all outside litigation and personal matters before administrative bodies.
• Perform other duties as assigned.

The mission of the WV Offices of the Insurance Commissioner is to promote a competitive and solvent insurance market with adequate consumer protection by fairly and consistently administering the insurance laws of West Virginia.

The ideal candidate will be responsible for performing the following duties:

• Under the administrative direction of the Insurance Commissioner, this position will serve as the General Counsel for the agency and will provide legal advice to the executive team and others in the agency regarding applicable statutes, rules, and regulations.
• Will perform advanced legal research, prepare legal memorandums and briefs on complex insurance issues, draft bills and rules, and other related documents.
• Analyze and summarize laws from other states related to insurance issues pending the state of West Virginia.
• This role involves representing the agency in matters before the Legislature and testifying before legislative committees regarding bills and study topics, as well as collaborating with committee counsel on these matters.
• The selected candidate will correspond with legislators and the public as needed when inquiries are received.
• Manages all outside litigation and personal matters before administrative bodies.
• Performs other duties as assigned.

Training: Admission to practice law in the State of West Virginia.

Experience: Nine years of full-time or equivalent part-time paid experience in the practice of law, including trial experience in administrative or judicial proceedings.

Substitution: One year of full-time or equivalent part-time paid employment as an attorney with the agency to which assigned shall be considered the equivalent of two years of other qualifying experience.
