Position Overview

We are seeking a highly skilled and mission-driven Federal Civil Litigation Attorney to join our legal team, with a focus on immigration-related habeas corpus litigation and other federal civil litigation matters. This position is open to remote or in-house applicants and offers the opportunity to play a pivotal role in challenging immigration detention, due process violations, and systemic abuses in the federal immigration system.

The ideal candidate will have substantial experience litigating in federal court, particularly in matters involving immigration detention , constitutional claims , and post-conviction immigration relief under statutes such as 28 U.S.C. § 2241 and the INA. This role will involve both individual representation and impact litigation at the trial and appellate levels.

Key Responsibilities

  • Litigate immigration-related habeas corpus petitions under 28 U.S.C. § 2241 and related federal statutes.
  • Challenge unlawful immigration detention, prolonged detention, and due process violations through federal court litigation.
  • Draft and argue motions, conduct discovery, and handle evidentiary hearings and appeals in U.S. District Courts and Courts of Appeals.
  • Develop and support strategic litigation to address systemic issues in immigration enforcement and detention.
  • Conduct in-depth legal research and draft high-quality pleadings, legal memoranda, and appellate briefs.
  • Collaborate closely with detained clients, co-counsel, advocacy organizations, experts, and investigators.
  • Stay current on legal developments in immigration detention law, federal habeas jurisprudence, and constitutional issues.

Qualifications

  • J.D. from an accredited law school and active bar membership in at least one U.S. jurisdiction.
  • Admission to practice in federal district and appellate courts.
  • 3–7 years of relevant federal litigation experience, with strong preference for work involving immigration habeas or constitutional challenges to detention.
  • Strong knowledge of immigration law, federal court procedures, habeas corpus litigation, and constitutional protections for noncitizens.
  • Excellent writing, research, and oral advocacy skills.
  • Ability to independently manage a litigation caseload while also working as part of a collaborative legal team.
  • Deep commitment to defending the rights of noncitizens and challenging systemic injustices in immigration enforcement and detention.

Preferred Qualifications

Experience with litigation under 28 U.S.C. § 2241 or immigration-related class action litigation.

Familiarity with conditions-of-confinement claims, Bivens actions, or other constitutional litigation in the immigration context.
