Qualifications

Responsibilities

• Serve as the enterprise-wide legal SME on fair lending laws and related guidance (ECOA, CRA, HMDA).
• Advise business units across Capital One on fair lending initiatives and compliance with lending laws.
• Lead internal and external advocacy related to CRA, HMDA, and Section 1071 rulemakings.
• Provide supporting consumer fair lending legal counseling as needed.

Director, Assistant General Counsel- Fair Lending**Overview:**Capital One’s Consumer & Small Business Legal Team is seeking an experienced and strategic attorney to help facilitate access to business credit in a Director - Fair Lending, Assistant General Counsel role. The attorney in this position will work closely with a number of Capital One’s business credit and operations teams, Compliance, and across the Legal department to manage compliance, litigation, and brand risk. The attorney will provide legal guidance on fair lending laws and regulations including the Equal Credit Opportunity Act, the Fair Housing Act, the Community Reinvestment Act (CRA), and the Home Mortgage Disclosure Act (HMDA). The attorney will also serve as a business counsel to the Community Impact & Investment Team, which will include leading legal support for the advancement of Capital One’s $265 billion Community Benefits Plan.The successful candidate must have strong legal and analytical skills, an ability to navigate novel legal and business situations, and the flexibility to simultaneously manage a wide range of projects while working seamlessly with our business and legal partners.****Responsibilities Include:***** Serve as the enterprise-wide legal subject matter expert on laws, regulations, and guidance related to: business credit antidiscrimination, the CRA, HMDA, and Small Business Data Collection (Section 1071 of the Dodd-Frank Act)* Advise Capital One’s Small Business and Commercial Banks, Card, and Community Finance businesses and related support departments on business initiatives related to fair lending* Support Fair and Responsible Banking Compliance and Global External Affairs in the strategic implementation of Capital One’s fair lending, CRA, and HMDA compliance management programs* Lead internal and external legal advocacy efforts related to CRA, HMDA, and Section 1071 of the Dodd-Frank Act rulemakings* Provide supporting consumer fair lending legal counseling, as needed****Basic Qualifications:***** Juris Doctorate from an accredited law school* Active member in good standing of at least one state bar* At least 8 years of experience as an attorney in a law firm environment, at a government agency, as a military judge advocate, or as in-house counsel ****Preferred Qualifications:***** 10+ years of experience as an attorney working on commercial or consumer regulatory matters* A thorough knowledge of ECOA, the Fair Housing Act, CRA, HMDA and other accompanying regulatory lending laws and regulations* Financial services industry knowledge and expertise, including experience with regulatory requirements relating to business credit products and services* Ability to build collegial and effective relationships with business clients, attorneys, project managers, and corporate compliance professionals* Ability to prioritize and manage a significant volume of legal questions on a broad array of topics with multiple and simultaneous deadlines* Ability to rapidly synthesize new information and make quick, well-grounded decisions* Strong oral communication skills with the ability to influence others* Strong legal writing skills, including experience drafting comment letters or other regulatory advocacy documents****At this time, Capital One will not sponsor a new applicant for employment authorization for this position.****The minimum and maximum full-time annual salaries for this role are listed below, by location.
