Job summary

The California Department of Justice—Division of Medi-Cal Fraud and Elder Abuse (DMFEA), Facilities Enforcement Team—seeks a Deputy Attorney General to prosecute elder abuse and related fraud.

The role involves collaboration with attorneys, nurses, and special agents to advance cases from investigation through trial in Southern California.

Qualifications

  • Criminal jury trial experience and familiarity with felony prosecution is preferred.
  • Ability to work with a multidisciplinary team of attorneys, nurses, and agents.
  • Willingness to travel within Southern California as needed.

Responsibilities

  • Work with a multidisciplinary team to investigate abuse and neglect referrals and complaints.
  • Advise on investigative plans, warrants, interview strategies, and engage expert witnesses.
  • Evaluate evidence and potential theories for filing decisions.
  • Prosecute criminal elder abuse cases in state court at all stages of litigation.
  • Assist with unannounced inspections of nursing home facilities as part of the Operation SAFE program.
  • Participate in training and public/law enforcement outreach.

Are you interested in protecting California’s vulnerable adults? Do you want to help stop abuse and neglect in nursing homes? Join a multidisciplinary team of attorneys, nurses, and special agents working together to prosecute elder and dependent adult abuse in California.

Within the Office of the Attorney General, the Division of Medi-Cal Fraud and Elder Abuse (DMFEA) works to investigate and prosecute fraud against the Medi-Cal program and abuse and neglect within California’s long-term care facilities. Within DMFEA, the Facilities Enforcement Team (FET) Criminal Team plays a unique and critically important role in ensuring the safety and care of elderly and dependent persons residing in nursing homes and other facilities by investigating and prosecuting allegations of abuse and neglect.

Typical duties of the FET Criminal Team Deputy Attorney General include:

  • Working collaboratively with a multi-disciplinary team of attorneys, special agents, nurses, auditors, and legal staff to investigate abuse and neglect referrals and complaints.
  • Advising on the development of investigative plans, including reviewing warrants and interview strategy, and working with expert witnesses under a vertical prosecution model.
  • Evaluating evidence and potential theories of culpability for a filing decision.
  • Prosecuting criminal elder abuse cases in state court at all stages of litigation, including charging, motion work, settlement or jury trial, and sentencing.
  • Assist with unannounced inspections of nursing home facilities as part of the Operation SAFE program.
  • Participate in training and public/law enforcement outreach.

This position will be responsible for cases throughout Southern California and may require travel. Applicants must demonstrate good judgement and professionalism in all interactions with members of the public, colleagues, opposing counsel, and the judiciary. Criminal jury trial experience and familiarity with felony prosecution is preferred.

  • The Deputy Attorney General classifications qualify for a “Hire Above Minimum" (HAM) salary ( Hiring Above Minimum Policy ).
The Starting Salary For Each Classification Will Be
  • Deputy Attorney General III (5 years): $12,046
  • Deputy Attorney General IV (6+ years): $13,313
  • Deputy Attorney General V (lateral only): $14,051

New to State candidates in the DAG series will be hired at the starting HAM salary of the classifications.
