Hive + Co is seeking a lead Contract Analyst to negotiate, draft, and administer moderate to highly complex Engineering, Procurement and Construction contracts, coordinating with Legal and internal stakeholders.

The role requires a BS in business/finance and at least 8 years of contracting experience; you will report to leadership on contract health and help shape contracting strategies.

Qualifications

  • Bachelor’s degree in Business Administration, Finance, or related field.
  • 8+ years of experience applying contracting principles.
  • Experience negotiating terms, drafting and administering contracts.
  • Strong problem-solving and analytical skills.
  • Advanced degree such as MBA or JD preferred.

Responsibilities

  • Negotiate contract terms and analyze commercial sections across proposals.
  • Prepare, maintain and communicate records and reports for contract requirements.
  • Provide consultative contract administration support for project leadership.
  • Protect company interests by enforcing warranties and mitigating risk.
  • Develop and execute risk mitigation and claims prevention strategies.
  • Develop standard contract templates and project procedures.
  • Manage supplier performance criteria and service levels.
  • Oversee amendments to agreements using various models.
  • Lead negotiation strategies for highly complex deals.
  • Analyze pricing claims and negotiate settlements on changes-in-law.
  • Coordinate and track documents for force majeure events.
  • Ensure activities comply with company policies.

Job description

This Contract Analyst contract position serves as a lead and is responsible for negotiating, drafting and administering moderate to highly complex Engineering, Procurement and Construction contracts, working in conjunction with Legal and other internal stakeholders to protect the interests of the Company. This role ensures compliance with all statutes, regulations, Company policies, and contractual obligations. The position requires the Contract Analyst to report to project, department and company leadership on the health of the assigned contract(s) and participate in the development and approval of contracting strategies.

Essential Job Functions:
  • Negotiate contract terms and conditions, analyze commercial sections of proposals and technical proposal evaluations, and coordinate technical scopes of work, interfacing with all project disciplines, including project controls, legal, project management, construction, engineering, finance/accounting and suppliers.
  • Prepare, maintain, retrieve and communicate records, reports or documents that may be required to meet corporate and Contract Administration requirements.
  • Provide consultative, analytical and contract administration support for the project management, project controls, construction management leadership and other senior leaders.
  • Protect the Company’s interest by enforcing warranties and mitigating risk.
  • Develop a claims prevention program.
  • Execute portfolio assignments as requested, perform contract risk assessments, and formulate mitigation strategies.
  • Develop standard contract templates for a project, prepare project contract procedures, and provide input to project final report.
  • Develop Supplier performance criteria and service levels that align with business requirements.
  • Manage and oversee amendments to existing agreements using various models.
  • Lead the negotiation process through strategy development, issue recognition, and escalation of issues for highly complex negotiations.
  • Analyze vendor pricing claims and lead in negotiating settlements for impact of changes-in-law and governmental impositions.
  • Coordinate, prepare, and track documents to declare, close, and quantify impact of Company force major events.
  • Ensure all work activities are performed in accordance with the policies, practices, standards, and rules of the company.
  • Other duties as assigned.
Minimum Requirements:
  • Education: Bachelor’s degree in Business Administration, Finance, or related field of study.
  • Work Experience: Minimum of 8 years of related experience in work activities and projects requiring the application of Contracting principles.
  • Demonstrate significant experience in a moderate range of subject categories relevant to areas of contract responsibility.
  • Apply problem-solving skills and use creativity in problem solving.
Preferred Qualifications:
  • Advanced degree such as a Masters in Business Administration, Law degree or global equivalent.
  • Twelve (12) years of contract administration, subcontract administration, and procurement experience supporting engineering and construction projects.
  • Experience developing and negotiating contracts terms and conditions, specifically for contracts related to services, construction, engineering, materials and equipment installation.
  • Broad understanding of the construction industry and contract language associated with engineering, procurement and construction/construction management.
  • Experience administering the Request for Proposal/Request for Quotation process for contractors on industrial construction projects.
  • Experience in work change, claims evaluation and negotiation.
  • Experience in creating project specific contract terms and conditions by flowing down terms from the Prime Contract.
