MINIMUM QUALIFICATIONS:
EXPERIENCE SUBSTITUTION:
Every 30 semester hours earned from an accredited college or university will be credited as one year of experience towards the six years of full-time work experience in any field. The maximum substitution allowed is 120 semester hours which substitutes for a maximum of four years of experience in any field.
FUNCTION OF WORK: Conducts investigations on violations regarding Board/Agency policies, state and federal statutes, Civil Service rules, licensure and/or ethics.
LEVEL OF WORK: Entry.
SUPERVISION RECEIVED: Direct from a Compliance Investigator 4-B, Executive Director or higher-level administrator.
SUPERVISION EXERCISED: None.
LOCATION OF WORK: May be used by all state agencies.
JOB DISTINCTIONS: Differs from law enforcement investigators by emphasis on administrative rather than criminal investigations. Differs from Compliance Investigator 2 by performing entry-level compliance investigations. Differs from Compliance Investigator 4-B by absence of supervision duties.
75% Case Management and Disciplinary Hearings: Receives, examines, and analyzes case information, typically in the format of a Case Review Report, regarding alleged violations of the Nurse Practice Act and/or LSBN rules and regulations for all cases assigned and for all priority levels, with Priority 1 cases being the most serious threat to public health and safety and Priority 4 cases being the least severe. Obtains and reviews records for accuracy, completeness, and authenticity. Consults with the Prosecuting Attorney and assists in determining whether the investigation substantiated the alleged violation, identifying any deficiencies requiring follow-up.
Prepares and issues subpoenas for records and evidence from a variety of sources, including health care entities, employers, drug testing laboratories, and law enforcement agencies. Prepares and issues witness subpoenas.
Drafts appropriate disciplinary documents. Reviews work product to ensure that content is clear and free of grammatical errors, has the appropriate syntax, and that the sentence structure is appropriate. Uses templates for documents, as directed.
Ensures that proper notice is timely given to Respondents, attorneys, witnesses, board staff, and other interested parties regarding conferences, interviews, meetings, hearing preparation, depositions, notice of formal charges and hearings, summary suspensions, final orders, etc.
Participates in settlement negotiations, investigating matters that may impact settlement and the prosecution of disciplinary cases, including outstanding and late-surfacing issues and investigatory leads.
Communicates with Respondents, attorneys, and board witnesses as needed.
Prepares evidence and other legal documents, in the format of a Board Book, for presentation to the Board Panel. Evidence should be reviewed for proper redactions. Facilitates the presentation of evidence at hearings. May be called to testify in some instances as a witness at hearings.
Collaborates with legal team to respond to Interrogatories, Requests for Admissions, and Requests for Production of Documents, as well as other requests for records and information, by researching files and drafting the initial response for approval.
Collaborates with the legal team to schedule depositions and conferences as needed. Interviews and/or participates in the interview process for potential witnesses for administrative hearings and litigation cases, as directed.
Enters information, including notes and board action, into required internal databases on a timely basis. Continuously reviews files and updates status, to maintain knowledge of assigned cases and to ensure that such cases are moving toward resolution through disciplinary action or closure without action. Advises the legal team regarding aging cases or cases that require review, to move such case towards closure. Advises the legal team of any other requirements or deadlines relevant to effective and efficient case management. Participates in case status meetings and discussions.
Manages assigned cases. Maintains a docket for disciplinary hearings, including a board case list and a Confluence agenda. Circulates the appropriate documents to the appropriate parties in preparation for hearing dates on a predetermined timeline, set forth in the shared Hearings Department calendar.
Maintains organized paper files, as well as electronic files utilizing the shared Legal drive, Laserfiche, and/or ORBS, as directed. Organizes paper and electronic files for closure and further processing, after final resolution of disciplinary cases.
20% Administrative: Provides comprehensive administrative and other support for the resolution of disciplinary cases by settlement or prosecution at board hearings. Duties may include, but are not limited to: receiving, sorting, and distributing mail/electronic mail; filing records into associated board files, while maintaining approved file order; retrieving board files from and returning board files to terminal files or Laserfiche e-folders; maintaining an organized filing system, by adhering to standards of paper and electronic filing systems that enable others to access necessary records when needed; and participating in record retention procedures, as directed. Reviews and prepares electronic/paper files, routing such files to the proper personnel, department, or Laserfiche folder.
Prepares certified mail and ensures delivery to the U.S. Post Office within prescribed timeframes; Bates-stamps evidence pages, placing exhibit stickers on evidence and entering page numbers into the List of Exhibits and Witnesses; and Updates the board hearing evidence book with newly received evidence; assists with producing post-hearing thank you letters to witnesses.
Assists during and after board hearings as directed, including greeting witnesses and facilitating sign-in sheets; receives and checks evidence books; maintains sign-in records; attends to the needs of attendees and witnesses; and performs other duties as directed during board hearing days.
Provides high level administrative assistance to Executive Counsel and Attorney Supervisor. Duties may include but not be limited to the following assists in reviewing and responding to public.
5% Internal and External Customer Service: Maintains excellent customer service to external and internal customers, guided by mutual respect. Promptly responds to telephone calls and e-mails, providing accurate information as needed.
Communicates and cooperates with board staff, law enforcement, federal and state agencies, and other entities, such as professional organizations, hospital administrators, healthcare entities and providers, elected officials, the general public, and other licensing and/or certification entities relative to the status of applicants, compliance, statutes, rules and regulations, policies, and board procedures.
Assists in responding to requests for information, including but not limited to licensure status, board disciplinary action, rules and regulations, policies, and board procedures.
Keeps the Prosecuting Attorney and the CLO informed of issues and concerns within his/her area of responsibility.
Works cooperatively as a member of the team, assisting and relieving other staff members as needed.
Maintains strict confidentiality of board records and information.
Assumes other duties as necessary for the smooth and efficient operation of the Louisiana State Board of Nursing, in order to safeguard the life and health of the citizens of Louisiana by assuring persons practicing as Registered Nurses and Advanced Practice Registered Nurses are competent and safe.
Prepares the initial draft of required documents for approval.
