Plaintiff-Side (Employee):

  • Responsibilities:
  • Representing employees in employment law disputes, including class action suits (wage and hour, discrimination, harassment), and individual plaintiff lawsuits. This includes managing cases from inception to trial, including investigations, client communication, document review, and negotiations.
  • Skills:
  • Strong legal research and writing abilities, excellent communication and interpersonal skills, ability to manage complex cases, and proficiency in employment law principles.
  • Key Tasks:
  • Drafting legal documents, including motions, pleadings, and briefs; conducting legal research; taking depositions; preparing for and participating in court hearings and trials; and negotiating settlements.

Defense-Side (Employer):

  • Responsibilities:
  • Representing employers in employment law matters, including single plaintiff suits and class actions, often involving discrimination, harassment, wrongful termination, and wage and hour claims. This includes defending against lawsuits, conducting discovery, and negotiating settlements.
  • Skills:
  • Strong understanding of employment law, excellent legal research and writing skills, ability to analyze complex cases, and experience in litigation and negotiation.
  • Key Tasks:
  • Drafting legal documents, including motions, pleadings, and briefs; conducting legal research; taking depositions; preparing for and participating in court hearings and trials; and negotiating settlements.

Class Action vs. Single Plaintiff:

  • Class Action:
  • Involves representing a group of plaintiffs (employees) with similar claims against a single employer. This requires managing a large number of cases and coordinating with class representatives and other attorneys.
  • Single Plaintiff:
  • Involves representing a single employee in an employment law dispute. This requires a more individualized approach, focusing on the specific facts and circumstances of the case.
