Job description

Civil Litigation Trial Attorney (Berkeley, CA, In Person)

We are seeking a highly skilled and compassionate Civil Litigation Trial Attorney with 5-10 years of California-based civil litigation experience to join our legal team. The ideal candidate will be dedicated to representing victims and families in Elder Abuse and Wrongful Death cases. This Attorney will provide legal counsel, advocacy, and representation through trial and/or appeal for victims and their families in elder abuse and wrongful death cases. This position does not have a monthly billable hour requirement. Attorney hours are tracked for plaintiff's fee award petitions. This is a full‑time, in‑office position.

Why Choose Our Team?

Join our team at York Law Firm and be an advocate for elder abuse and wrongful death victims and their families to ensure justice and accountability for our elders and their families. Our mission is to uncover elder neglect and fraud and to hold bad long‑term care operators and companies accountable for the exploitation of our seniors. Your commitment to providing empathetic and high‑quality case work‑up will contribute to ensuring justice, accountability, and closure for elderly victims swiftly and efficiently within the legal system.

Responsibilities
  • Legal Representation: Provide legal representation for victims and their families in wrongful death and elder abuse, neglect, financial exploitation, and other forms of mistreatment for all phases of litigation and through trial.
  • Case Management: Manage a caseload of elder abuse cases, from pre‑litigation through trial, conducting thorough investigations, executing an organized discovery and trial plan, gathering evidence, and collaborating with health care providers, consultants, and experts while also implementing a strong settlement strategy parallel to working up cases for trial. The ideal candidate has trial and arbitration experience.
  • Discovery Expertise: Experience with creating a discovery plan, executing on discovery, diligent meet and confer follow‑up, and filing of discovery motions, taking and defending all types of witness depositions, experience with ESI discovery, and use of e‑Discovery platforms. Ready to be a part of a litigation team that takes a disciplined approach to discovery.
  • Advocacy: Advocate for the rights of victims and families in wrongful death and elder neglect, and abuse cases.
  • Client Communication: Maintain regular communication and rapport with clients, keeping them informed about the progress of their cases, explaining legal processes, understanding their harms and losses to develop their damages work‑up, and addressing their concerns.
  • Collaboration: Collaborate with our team, public agencies, medical professionals, and other relevant parties to build a strong case work‑up.
  • Legal Research: Stay updated on relevant laws, regulations, and precedents related to elder abuse, and apply procedural and substantive legal knowledge to build effective cases.
  • Legal Team Support: Embraces teamwork, provides support to others within the firm in a team environment, with a demonstrated willingness to contribute and collaborate with team members to achieve best‑case results for all of our clients.
  • Time Management: Aligned with a culture that measures time‑on‑desk to improve workflow and deliver case closure to clients in an efficient, yet high‑quality manner. Is acutely aware of defense attempts to delay cases and discovery, and implements a strategy to prevent any effort to stall clients' cases.
Qualifications
  • Juris Doctor (JD) degree from an accredited law school and a four‑year college degree.
  • Admission to the California state bar and in good standing for a minimum of 5 years.
  • Minimum 5 years of civil litigation experience in California state and federal courts. Previous experience in business litigation or medical malpractice preferred.
  • Minimum 1 jury trial as first chair, experience with binding arbitration hearings, law and motion hearings, and second‑chair trial experience.
  • Experience taking and defending depositions of all types of witnesses (lay, professional, and expert).
  • Strong law and motion experience with strong writing skills.
  • Experienced in handling complex legal issues and cases, welcomes the challenge and thrives on simplifying the complex.
  • Empathy and sensitivity to the needs of elderly clients and their families.
  • Excellent communication and interpersonal skills.
  • Ability to work independently and collaboratively within a team environment.
  • Commitment to ethical and professional standards.
Work Culture and Values

We value bright, organized, problem‑solving, responsible, and truthful individuals who take initiative, are disciplined, proactive, and demonstrate efficiency and organization in all tasks. The ideal candidates will take ownership of their work product, be service‑oriented, and prioritize the needs of our clients above all. Strong collaboration skills are essential, as we value working together to achieve the best outcomes for those we serve.

We invite candidates who share our values and are ready to have fun uncovering the fraud in a broken long‑term care system and to collaborate in making an impact by holding bad operators accountable through the legal system. This might sound cliché, but this practice can be fun for the aligned team member with shared professional values. Our ideal team member should be committed to continuous learning, eager to embrace new skills, and proactively pursue opportunities for personal and professional growth. We are looking for a candidate who is ready to lean into challenges, support the team, and take responsibility for the impact of their work.
