Job description

Under the general direction of the Chief Counsel and Deputy Chief Counsel, the Attorney IV will handle the most difficult and sensitive legal issues involving the Department of State Hospitals (DSH) and advises personnel at the highest levels of government regarding his/her/their area of expertise.

The Attorney IV, Chief Privacy Officer is a legal specialist in privacy, data release, data use and sharing contracts, compliance, legislation, policies, and procedures, and is involved with litigation strategy, legal research, and opinion drafting on the most complex legal issues facing DSH. The Attorney IV, Chief Privacy Officer must operate with minimal direction.

The Attorney IV, Chief Privacy Officer functions in a lead capacity and mentor with respect to other attorneys within the Legal Division. The Attorney IV, Chief Privacy Officer may be assigned primary research/investigative and decision-making authority, subject to a higher-level review, for matters within his/her/their unique area of subject matter expertise.

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

  • Expertise on the applicability of the following State and federal privacy laws to a large healthcare organization: the Health Insurance Portability and Accountability Act (HIPAA); Lanterman-Petris-Short Act; Information Practices Act, Confidentiality of Medical Information Act (CMIA); the privacy provisions of the California Constitutions, and the Public Records Act.
  • Experience in mental health law; civil litigation; subpoena and document production; public contracting; regulations; and legislation.
  • Knowledge of rules of evidence, civil and criminal procedure, and conservatorship and involuntary commitments as delineated in the Probate, Welfare and Institutions and Penal Codes.
  • Excellent written and verbal communication skills and well-developed work habits, including organization and ability to complete work under deadlines or shift priorities as needed.
  • Astute legal analysis and research capability and aptitude for applying unclear, complex, and competing legal requirements.
  • Experience exercising discretion and sound judgment in formulating legal recommendations on novel and emerging legal questions.
  • Demonstrated ability to maintain effective and collaborative working relationships with colleagues, program staff and management, staff of other state and federal agencies, and client advocacy organizations, while working independently and as part of a team.
  • Demonstrated ability to work in politically sensitive areas, under significant pressure and short time frames, with diplomacy and sound judgment.
