Responsibilities

  • Represent clients in SBA loan defaults, demand letters, and Treasury referrals.
  • Draft and review personal guaranty agreements and loan authorization packages.
  • Counsel clients on SBA EIDL compliance obligations.
  • Coordinate with loan service centers and SBA offices as needed.
  • Assist clients facing SBA litigation, judgment enforcement, or bank levies.
  • Advise on related government-backed lending programs.
  • Represent clients before SBA offices of Hearings and Appeals.
  • Monitor SBA regulatory changes and advise accordingly.

Job Overview

A law firm seeks an experienced Attorney in Annapolis, MD, to join its Business & Commercial practice, focusing on U.S. Small Business Administration (SBA) Economic Injury Disaster Loan (EIDL) programs and related federal lending matters. This role involves advising small business owners on complex federal lending obligations and collaborating with a team of legal and financial professionals.

Duties
  • Advise and represent clients in all phases of SBA EIDL matters, including loan modifications and repayment negotiations
  • Represent clients in SBA loan defaults, demand letters, and Treasury referrals
  • Draft and review personal guaranty agreements and loan authorization packages
  • Counsel clients on SBA EIDL compliance obligations
  • Handle matters involving the SBA's Office of Disaster Assistance and coordinate with loan service centers
  • Assist clients facing SBA litigation, judgment enforcement, or bank account levies
  • Advise on related government-backed lending programs
  • Represent clients before the SBA's Office of Hearings and Appeals
  • Monitor changes in SBA regulations and advise clients accordingly
  • Collaborate with financial advisors and bankruptcy counsel on debt resolution strategies
Requirements
  • Juris Doctor (J.D.) from an ABA-accredited law school and active bar admission in good standing.
  • 2+ years of experience in SBA lending, federal loan workout, or related legal matters.
  • Strong understanding of SBA Standard Operating Procedures and loan program regulations.
  • Excellent written and oral advocacy skills.
  • Ability to manage a high-volume caseload with strong attention to detail.
  • Strong negotiation skills in workout and settlement contexts.
  • Ability to analyze financial statements and business tax returns.
  • Experience with SBA EIDL, PPP forgiveness disputes, or COVID-era federal loan programs preferred.
  • Familiarity with the Treasury Offset Program and cross-servicing procedures is a plus.
  • Working knowledge of Chapter 7 and Chapter 11 bankruptcy is a plus.
Education
  • Juris Doctor (J.D.) from an ABA-accredited law school.
Certifications
  • Active bar admission in good standing.
