The Associate General Counsel will be a critical member of the legal department, responsible for providing legal advice and support across the company's payment and loan product lines. This role will involve a broad range of legal and regulatory matters, requiring a strong understanding of financial services law, consumer protection regulations, and the Fintech landscape. The ideal candidate will be a proactive problem-solver with excellent communication and negotiation skills, capable of working independently and collaboratively with cross-functional teams.

Key Responsibilities:
  • Provide expert legal counsel and guidance to the company's business units on all aspects of its payment and loan products, from development and launch to ongoing operations and compliance.
  • Advise on federal and state laws and regulations applicable to payment processing (e.g., EFTA, NACHA rules, card network rules), lending (e.g., TILA, FCRA, ECOA), and consumer protection (e.g., UDAAP, TCPA, CAN-SPAM).
  • Develop, review, and update terms and conditions, disclosures, policies, and procedures related to payment and loan products to ensure compliance and mitigate legal risks.
  • Draft, review, and negotiate a wide range of commercial agreements, including partnerships with financial institutions, technology vendors, and other service providers.
  • Advise on regulatory inquiries, examinations, and enforcement actions related to payment and lending activities.
  • Monitor and analyze new and evolving legislation, regulations, and industry trends in the Fintech and financial services space, providing proactive guidance on potential impacts to the company's products and operations.
  • Collaborate with compliance, risk, product, engineering, and other internal teams to ensure legal considerations are integrated into product development and business strategies.
  • Manage and instruct external legal counsel as needed.
  • Develop and deliver training to internal stakeholders on relevant legal and regulatory matters.
  • Assist the General Counsel on various legal projects and initiatives.
Skills and Qualifications:
  • Juris Doctor (JD) degree from an accredited law school.
  • Admission to the bar of at least one US state (preferably California).
  • Minimum of 10-12 of relevant legal experience, with a significant focus on financial services law, particularly in the areas of payments and lending.
  • In-depth knowledge of federal and state regulations governing payment processing and lending, including but not limited to:
  • Electronic Fund Transfer Act (EFTA) and Regulation E
  • Truth in Lending Act (TILA) and Regulation Z
  • Fair Credit Reporting Act (FCRA) and Regulation V
  • Equal Credit Opportunity Act (ECOA) and Regulation B
  • Unfair, Deceptive, or Abusive Acts or Practices (UDAAP)
  • Telephone Consumer Protection Act (TCPA)
  • CAN-SPAM Act
  • NACHA Operating Rules
  • Card network rules (e.g., Visa, Mastercard, American Express)
  • State-specific lending and consumer protection laws
  • Strong understanding of the Fintech and neo banking landscape, including emerging payment technologies and alternative lending models.
  • Experience drafting and negotiating complex commercial agreements.
  • Excellent legal research, analytical, and problem-solving skills.
  • Exceptional written and verbal communication skills, with the ability to explain complex legal concepts clearly and concisely to non-legal stakeholders.
  • Proven ability to work independently, manage multiple priorities, and meet deadlines in a fast-paced environment.
  • Strong business acumen and the ability to provide practical and strategic legal advice.
  • Excellent interpersonal and collaboration skills, with the ability to build effective working relationships across the organization.
  • Experience working in-house at a Fintech company or financial institution is highly preferred.
  • Familiarity with privacy laws (e.g., CCPA, GDPR) and data security regulations is a plus.
  • Experience with regulatory interactions and enforcement matters is beneficial.

Pay Transparency Notice:

It’s all part of a more comprehensive DEI strategy that helps level the playing field. The base salary range for this role is $320,000 - $351,875, plus equity and benefits.
