Base pay range
$70,951.00/yr - $125,413.00/yr
Responsibilities Include, But Are Not Limited To
- Reviewing the merits of appeal requests by analyzing documents in the Workers’ Compensation Board’s (WCB) eCase and internal NYSIF databases.
- Reviewing the WCB's digital audio recordings of hearings and depositions, researching applicable law, and case documents.
- Communicating, discussing, and explaining to Claims Department staff the basis for rejections of appeal requests.
- Preparing and timely filing clearly written and persuasive appeals, rebuttals, and memos of law with references to appropriate case law and statutes to support NYSIF's interests.
- Handling complex cases and managing a high volume of cases efficiently.
- Managing rush or emergency matters arising from the strict time constraints imposed by the Workers’ Compensation Law.
- Assisting in case assignments when the Appeals Unit Manager is absent for extended periods.
- Reviewing and analyzing Board Panel and Full Board decisions, providing well-reasoned recommendations for further appeals.
- Drafting appellate briefs and motions to the Appellate Division and Court of Appeals.
- Participating in training modules and developing training materials.
Preferred Qualifications
- Attention to detail, excellent communication skills, and efficient time management.
- Expertise in conducting thorough legal research using various databases, libraries, and online resources.
- Ability to analyze statutes, case law, regulations, and legal precedents to support legal decisions.
- Strong legal writing skills with clarity and persuasiveness.
- Experience in producing high-quality legal documents, opinions, and other written materials.
- Proficiency in Microsoft Excel, Word, SharePoint, and other computer skills.
- Proactive attitude towards learning and adapting to new technologies.
- Experience managing multiple projects while meeting deadlines.
- Participation in or management of research projects within WCL, providing results and recommendations for improvement.
Qualifications
Minimum Qualifications
- Law school graduation and/or eligibility for NYS Bar Admission.
For Appointment to Assistant Attorney 2 (Grade 20)
For Appointment to Assistant Attorney 3 (Grade 22)
- 12 months as an Assistant Attorney 2 or equivalent legal experience.
For Senior Attorney (Grade 25)
- Current Civil Service eligible list, or one year of service as a Senior Attorney, or transfer eligibility, or 12 months as Assistant Attorney 3, or equivalent legal experience.
Note: Continued employment requires admission to the NYS Bar and current registration to practice law in NY. Disbarment or loss of registration results in termination or suspension.
