Qualifications

• Admission to the NYS Bar; then either experience 2 or 3.
• One year of US legal experience after admission to a state bar.
• Six months as Agency Attorney Interne (30086).
• AL II requires 1 year at AL I or 2 years comparable legal experience.
• AL III requires 2+ years at AL I/II or 3 years comparable experience.
• Substantial experience in criminal law; prosecutorial or investigative background.
• Training experience; evaluating disciplinary matters is helpful.

Responsibilities

• Conduct legal research on critical criminal law and procedure topics.

Job description

The mission of the New York City Police Department is to enhance the quality of life in New York City by working in partnership with the community to enforce the law, preserve peace, protect the people, reduce fear, and maintain order. The Professional Standards Division assists the Department in accomplishing its objectives by applying a systematic approach to developing and implementing compliance mechanisms, providing objective and independent evaluations to reduce risk and improve operations, and devise corrective solutions to non-compliance.

The division also develops and implements compliance mechanisms to ensure individual and institutional compliance with Department policy, applicable laws, and external oversight.

They also assess the effectiveness of training and policy in achieving desired risk reduction outcomes and conducting all other independent evaluations at the direction of the Deputy Commissioner, Legal Matters.

In partnership with the Training Bureau and Deputy Commissioner, Legal Matters implements recommendations made by oversight bodies, including developing training programs and other corrective solutions.

Duties

• Conduct legal research on critical criminal law and procedure topics such as car stops and search and seizure law
• Draft memorandum of law to address legal questions related to Investigative Encounters
• Advise command leadership on changes to relevant criminal laws and emerging trends
• Communicate and coordinate with the NYPD Legal and Training Bureaus on compliance issues to be addressed through training
• Liaise with personnel to review documents and Body Worn Camera video related to Stop Question and Frisk law, and assist staff members in the proper application of NYS law by phone
• Train and advise Professional Standards Division personnel on 4th Amendment law and laws of investigative encounters in compliance with all related NYPD policy and court ordered training materials
• Recommend areas for policy improvement and risk management
• Provide guidance on legal issues that affect the Early Intervention Program
• Assist in the data gathering and preparation for ComplianceStat and other internal compliance meetings, including reviewing BWC videos and providing an assessment of the legality of officers' conduct

Hours/Shift

9x5, 10x6, Saturdays and Sundays RDOs

Minimum Qualifications

• Admission to the New York State Bar; and either "2" or "3" below.
• One year of satisfactory United States legal experience subsequent to admission to any state bar; or
• Six months of satisfactory service as an Agency Attorney Interne (30086).

Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.

In Addition To Meeting The Minimum Qualification Requirements

To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

Preferred Skills

• Substantial experience in the practice of criminal law - Prosecutorial or investigative experience in preparing complex cases and preparing evidence - Training experience - Background in evaluating disciplinary matters is helpful but not required
