Qualifications

Responsibilities

• Manages court docket, court schedules and ensures deadlines are met.
• Trains and assist in training less experienced misdemeanor prosecutors.
• Evaluates assigned case by reviewing documentation, performing legal research, interviewing witnesses, gathering evidence, and determining action.
• Drafts, files and responds to motions, briefs, or other legal documents for trial or hearing.
• Explains legal process to potential witnesses and prepares witnesses for court testimony while keeping clients informed.
• Gathers, prepares, and presents evidence for trial or hearing.
• Represents the State in trial/hearings with jury selection, opening statements, direct and cross-examinations, and closing arguments.
• Participates in settlement or plea-bargain negotiations.
• Prepares final settlement/plea documents and ensures signatures and filings.
• Performs other duties as assigned.

Description

Working under the supervision and direction of more experienced attorneys, completes legal assignments that are more difficult in nature, but usually involve limited responsibility. Work involves litigation and legal research; drafting legal documents; and interpreting laws, rules, and regulations OR prosecutes misdemeanor cases in assigned court. Manages assigned court, trains Attorney I's and monitors their performance and acts as a primary liaison with court judge. Performs case evaluation, preparation, and management; represents the state/client in pre-trial and evidentiary hearings and jury/court trials; and ensures effective communications with defense attorneys, court personnel, victims and family members, witnesses and other interested parties.

Responsibilities

1. Manages court docket, court schedules and ensures deadlines are met.
2. Trains and assist in training less experienced misdemeanor prosecutors.
3. Evaluates assigned case or lawsuit by: reviewing documentation, conducting necessary legal research on applicable law, interviewing witnesses or persons with knowledge, the case, gathering evidence, and determining most appropriate action(s) to be taken.
4. Drafts, files and responds to necessary motions, briefs, or other legal documents for trial and/or hearing.
5. Explains legal process to potential witnesses and prepares witnesses for court testimony and ensures client or victim/family are kept informed on status of case.
6. Gathers, prepares, and presents evidence, exhibits, and related material for trial or hearing.
7. Represents the State and client in trial and hearings by: conducting jury selection, presenting opening statements, conducting direct and cross-examinations of witnesses, and presenting closing arguments.
8. Participates in settlement or plea-bargain negotiations.
9. Prepares necessary legal document if settlement or plea-bargain agreement is reached and ensures signatures are secured and documents filed as required.
10. Performs other duties as assigned.

Qualifications

Education, Experience and Training:

Graduation from an accredited law school. Six (6) months of experience practicing law.

Special Requirements/Knowledge, Skills & Abilities:

Requires a current license to practice law in the State of Texas. Requires experience prosecuting all levels of misdemeanor offenses, including jury selection.
