Job description

Safeguard the company's interests in all commercial disputes by providing proper representation of cases, studying and offering the right advice to regions, and obtaining the best outcomes through watertight cases with the required documentary support for all claims, EOTs, and/or reaching the best settlement with clients/subcontractors. Ensure the implementation of standardized systems and processes across projects.

Requirements:

  • B.Sc. in Quantity Surveying or B.E. in Civil Engineering with RICS certification.
  • 20 years of experience with a civil contracting company in the commercial department, managing the commercial function independently across multiple projects.
  • Minimum 5 years of Middle Eastern experience.

Responsibilities:

  • Be an integral part of the multidisciplinary leadership team responsible for the overall profitability of all projects and securing the company's business interests.
  • Identify key commercial and contractual risks in main contracts and subcontracts, and develop mitigation plans in consultation with country and project heads.
  • Create and implement a uniform model contract outlining key terms and conditions applicable to all commercial contracts with clients and subcontractors.
  • Establish systems to capture all claims, variations, EOTs, impact analyses, work done, and ensure their successful resolution.
  • Train country and project heads on commercial and contractual risks and procedures as part of risk mitigation strategies.
  • Protect projects from liquidated damages due to non-compliance with contractual obligations through timely monitoring and review of work progress.
  • Ensure proper documentation of all matters with commercial or contractual implications, including financial aspects, and establish processes for their timely capture.
