JOB SUMMARY
Responsible for managing and advising on all litigation and dispute resolution matters involving the organization. The role involves analyzing and approving investigation papers referred for legal action, attending court proceedings including trials for both prosecution and civil cases extensive legal research, providing legal opinions encompassing contractual, commercial, investment, property, land matters disputes. Manage and liaise with external counsel including setting case strategies, reviewing and approving settlements.
JOB RESPONSIBILITIES
LITIGATION & PROSECUTION
- Analyse investigation papers submitted by inspectors for legal action namely prosecution and civil action.
- Conduct cases, including attending trials for prosecution actions taken by the Board against employers and other individuals involved for various offences under the Act, especially offences of employers failing to pay contributions within the prescribed period, failure to comply with official Board notices, failure to submit documents, and members who make withdrawals but do not use money for withdrawal.
- Attend and handle prosecution action cases and civil cases (which are handled internally) at all levels of courts for contested or non-contested.
- Conduct legal research.
- Provide legal opinion sought by internal and external.
- Provide legal advisory services to internal departments (contributions and non-contributions-related matters).
- Ensure that every prosecution and civil action referred by the branch is managed in a proper and orderly.
- Review Court decisions that are not in favour of the Board as well as prepare relevant reports/submissions to be considered for appeal to a higher.
- Handle civil law disputes, whether filed against the EPF Board or filed by the Board in the Magistrate/Secretary/High Court in Sarawak (contractual dispute).
- Handle cases related to nomination objections filed against the organization.
- Managing and reviewing the progress of all litigation cases and liaising with panel solicitors.
- Perform ad-hoc tasks as assigned.
JOB REQUIREMENTS
- Malaysian citizen.
- Pass Malay Language including oral test at Sijil Pelajaran Malaysia (SPM) level or equivalent as recognised by the Government.
- Possess a Bachelor of Laws (Honours) (LLB) or equivalent LLB qualifications from any local or overseas higher learning institutions recognised by the Government of Malaysia.
- Fresh graduate with excellent academic performance and up to 2 years of relevant experience in the required skillset.
- Ability to communicate complex legal concepts and issues clearly and effectively.
- Research abilities to gather relevant legal precedents and information.
- Excellent communication and presentation skills, with strong proficiency in both spoken and written English and Bahasa Melayu.
- Highly motivated and capable of working with minimal supervision.
- Able to work independently as well as collaboratively within a team, with a commitment to meeting tight deadlines.
- Detail-oriented with a focus on accuracy and precision.
- Strong negotiation and problem-solving abilities.
