Mahindra Finance is seeking a legal professional to manage notices, summons, and recovery efforts for defaulters. The role includes handling arbitration applications, execution petitions, and settlements with senior approval, plus coordinating with advocates and maintaining branch records.

Ideal candidate has an LLB with 2+ years of practice and 2 years of related industrial experience, will appear in courts, and report monthly to Head Office Legal Department.

Competenze

• L.LB degree with minimum 2 years of practice and 2 years of related industrial experience.
• Experience in legal notices, summons, warrants, and recovery processes.

Mansioni

• Send legal notices to defaulters and secure recovery of dues.
• Serve summons and warrants without delay.
• Conduct legal audits in branches and file criminal cases when required.
• File applications under the Arbitration and Conciliation Act to attach assets.
• Prepare execution petitions on arbitration awards from Head Office.
• Negotiate settlements with approvals from senior management.
• Arrange retainers and advocates as needed.
• File petitions to release assets in court and arrange disposal with Court/Authority
• Maintain branch records of bad debts and disposals; report hearing dates monthly.

Role & responsibilities

• Send legal notices to the defaulters, NPAs, Bad debts and Disposal loss booked contracts and recovery of the dues
• Summons and warrants to be served on accused without delay
• Conduct legal audits in the branches
• File criminal cases against defaulters
• File application U/S 9 of the Arbitration and Conciliation Act to attach the property or vehicle of the defaulters
• File execution petition as and when Arbitration awards received from Head Office
• Negotiation and settlement with approval from concerned AM/RM/ZM/GM
• Appointment of retainers and advocates as per requirements
• File Petition before the Court/Authority to release the vehicle in favour of the company and to dispose the same with permission of the Court/Authority
• Keep all the details of Unsolvable, bad debt, disposal contracts pertaining to the branches
• Appearing before the Courts/Forum and update all the hearing dates and send a monthly report to Head Office legal department through MIS

Any other assignment given from time to time
