Job description

Part 8 - Limitation Handler

Department: Legal

Employment Type: Permanent - Full Time

Location: Bolton

Description

The handler will be responsible for managing a caseload of MOJ/OIC cases that have reached limitation and subsequently issued and stayed. The handler will manage a full case load of files dealing with the procedural aspects of the case only, whilst ensuring the case is proactively managed to ensure all evidence is disclosed at the earliest point possible.

The handler will also manage a small volume of pre-litigation files, ensuring all procedural steps are followed, with responsibility for adhering to all MOJ/OIC deadlines, reserve management, valuing damages, and negotiating effectively within set parameters.

A good understanding of the MOJ/OIC protocol and/or CPR is necessary, along with the ability to identify large loss triggers.

Key Accountabilities
  1. Effectively manage the litigation process:
  • Draft and file all required court documents, such as notices of acting, applications, and consent orders.
  • Consider and manage applications for extension of stays.
  • Brief and liaise with Counsel.
  • Adhere to all court deadlines.
  • Identify cases with a value >£25k.
  • Identify large loss triggers.
  • Proactively control case life cycles.
  • Focus on phone contact.
  • Effective management of Stage 2:
    • Maintain accurate reserves.
    • Identify cases with a value >£25k.
    • Identify large loss triggers.
    • Value general and special damages.
    • Set strategy and negotiate effectively.
    • Manage Stage 2 through to CPP stage.
    • Handle Stage 2 costs.
    • Process settlements within the client environment.
  • Case management systems and IT:
    • Maintain all reserves and diary actions.
    • Ensure critical dates are met.
    • Be proficient in Microsoft Office (Excel and Word).
    Experience, Skills and Qualifications
    • Good knowledge of MOJ/OIC Civil Procedure Rules and associated time scales.
    • Experience in valuing damages using JC Guidelines and case law.
    • Experience in quantum negotiations.
    • Experience in drafting legal documents.
    • Ability to work to deadlines.
    • Experience dealing with Claimant Solicitors, policyholders, clients, and the Court.
    • Managing a caseload effectively.
    • Excellent listening and verbal communication skills.
    • Ability to remain calm under pressure.
    • Ability to accept feedback and pursue continuous improvement.
    • Strong planning and prioritization skills.
    • Efficiency in a process-driven environment.
