Purpose of the role:

We have an opportunity for an experienced Commercial Manager to join our Welfare business within the Central Government. The individual will assist the implementation of the Future Assessment Service contract in the lead up to service commencement and will provide in-life support afterwards. FAS is the successor to the Department for Work and Pensions' Personal Independence Payment contracts, which Capita has held since 2012.

This is a home-based role. Some travel will be required.

What you'll be doing:

Specifically in relation to our Welfare business within the Central Government team:

  • Review, interpret and advise on existing contract rights and obligations;
  • Identify, manage and report on key commercial / legal risks (legal risks to be communicated to Legal function and ongoing appropriate support / liaison to be maintained);
  • Work as part of management team, manage a pipeline of activity and contribute to client-specific strategy, review and performance;
  • Be a point of contact for clients and provide in-life client contract management support;
  • Provide commercial support in deal shaping, negotiations & contracting;
  • Support and advise on commercial disputes, lead settlement negotiations and define and record settlement terms (except in case of formal dispute/litigation);
  • Review existing pricing and new business proposals to ensure they are aligned with Group margin, risk and contingency provisions;
  • Ensure all customer and supplier bids/contracts/changes are approved and reviewed in line with Group governance and policy prior to submission/signature;
  • Draft client and supplier contracts and/or amendments and, where required, set up new internal/external supplier contracts;

  • Support production of regular contract reporting in line with governance and contract requirements;
  • Record, ratify and circulate commercial / negotiation meeting minutes when required;
  • Support the business by owning and performing the ongoing administration of contracts (including the provision of contractual templates / tool kits, and delivering notices);
  • Support sub-contractor relationship management;
  • Support due diligence and MI / audit data request activities.
What we're looking for:
  • Experienced Commercial professional who has a demonstrable track record in bidding, negotiating and/managing significant sales and supplier contracts
  • Extensive commercial and contracts experience in owning and delivering pre- and post-contract activity, including:
    • Good understanding of bid preparation and submission processes (ITT, RFP, BAFO);
    • Experience leading negotiations encompassing multiple disciplines, including supplier negotiations and flow-downs;
    • Ability to identify and analyse key commercial risks such as KPIs, SLAs, contractual dependencies and milestones;
    • Strong contract drafting and negotiation skills;
    • Strong knowledge of contract law and its application in SW / IT / BPO environments;
    • Good working knowledge of GDPR;
    • Strong financial acumen (P&L, cashflow, balance sheet) and understanding of financial modelling, contract pricing and differing pricing models;
    • Producing reports and summaries (ad hoc and regular) that clearly articulate key matters for a senior and/or non-commercial audience.
  • Experienced in defining, driving and overseeing commercial and contract governance
  • Diligent in document record-keeping and maintenance of audit trails
  • Starter - Finisher: seeing activities through to successful completion whilst creating a platform for engagement and collaboration

    • Strong and confident communicator able to successfully engage and influence at all levels of the organisation, including up to Divisional Management and senior members of Functional Teams
    • Champion to both the business and the Commercial function as a cross-functional leader and internal influencer
  • Ideally qualified to degree level or equivalent achieved through extensive and demonstrably successful experience
  • Industry Standard and/or Professional Body accreditations desirable e.g. IACCM, ICM or MCIPS
  • Experience working with UK public sector clients highly desirable
