Job description

Purpose of the Role

To ensure that all pre and post-contract commercial and contractual activities are carried out in a professional manner and in accordance with company procedures and strategies. Implement and manage procedures to ensure that contracts are controlled and managed to deliver the agreed contract margins and cash projections, whilst mitigating business risk and commercial exposure. To manage the tendering process and to act as the formal point of focus for all enquiries received by the business and all tenders issued by the business. To ensure that all tenders are prepared, reviewed and issued in a timely and professional manner and in the best commercial interests of the business. To support sales and marketing activities of the business.


Person Specification
  • Degree in Quantity Surveying / Commercial Management
  • Strong Negotiation skills
  • Strong Organisation and Coaching Skills
  • Experience of Network Rail forms of contract and their administration including NEC, ICE, MF/1 and JCT, in particular target cost contract
  • Knowledge of Tender preparation process
  • Possess a thorough understanding of commercial and financial matters

Key Responsibilities
  • Responsible for day to day commercial management, this includes the management and control of all our contractual rights, obligations and liabilities with particular emphasis on the identification, recording and management of variations, as well as supporting our operations management in operational cost control on all our activities. In addition to mitigate business risk and commercial exposure.
  • Direct report responsibility for Commercial Department as delegated by Head of Commercial.
  • Client contract and payment focused manager.
  • Management and monitoring of compliance with contractual obligations.
  • Managing client contractual correspondence.
  • Preparation/review of construction estimates through close liaison with delivery team and estimator.
  • Negotiation of rates with client.
  • Agree payment schedules with client including forecast payment expectations.
  • Submission of applications for payment.
  • Production, submission and settlement of claims.
  • Maximise value from contractual variations / claims and entitlements.
  • Ensuring timely payments from client.
  • Identify supply chain requirements.
  • Ensure planned works are within the pre-set budget limits.
  • Ensure robust process for sign off and authorisation of depot spend.
  • Manage the preparation from orders and race cards the management account accruals and issue to accounts.
  • Prepare income statement for monthly cost and value reconciliation including Anticipated Final Account provision.
  • Present monthly income recovery at CVR meeting pre month end.
  • Preparation of board report for commercial activities.
  • Manage risk expectations and obligations arising.
  • Managing insurance contribution and adequacy of cover provision.
  • Measurement and agreement of subcontract accounts.
  • Signing off subcontract payment certificates.
  • Work closely with Head of Commercial and undertake any short term assignments in other offices as required by the business.
  • Work closely with the Delivery, Procurement & Finance teams.
  • Prepare & Agreement of Final accounts.
  • Prepare Audit reports and close out audits with external and internal auditors.
  • Proactive approach to continuous improvement and innovation.
  • As you will expect the organisation may change from time to time and you will be expected to meet the operational requirements.
  • Any other reasonable duties as required from time to time.
