• Casual dress Employment Type: Full-time Job Summary Working in our specialist Housing Disrepair Breach of Contract Team, you will be responsible for drafting proceedings under Part 8 CPR and N244 Applications under Part 7 CPR on Claimant matters where the Defendant has breached previously agreed settlement terms. You will be supporting the team’s litigation fee earners who will take conduct post issue until conclusion. Purpose of the role The firm operates a very successful housing disrepair team whereby we act for tenants of residential social housing who are complaining of disrepair at their property which their landlord has failed to remedy. Cases are pursued under the Housing Conditions Protocol with typical agreements being reached with landlords pre or post litigation in terms of damages, agreed repairs, timescale for completion, and costs.
Unfortunately, a significant proportion of those agreements are subsequently breached by the landlord. Your role will be to assist in the enforcement of those agreed terms, particularly relating to any failure to complete agreed repairs at the property in the agreed timescale. Working within our Breach of Contract team, you will be responsible for drafting Part 8 Claim Forms and associated witness evidence, and N244 Application Notices to lift Stay of Proceedings on previously litigated matters. The main objective of the role is to prepare the case for handling by a litigation fee earner who will then retain conduct until conclusion. This will involve liaising with our clients by telephone on a regular basis to assist in drafting of necessary Court paperwork. Main duties and responsibilities
· Consideration of previous settlement agreement / terms and consideration of enforceability.
· Taking client instructions to establish what works at the property remain outstanding.
· Draft Part 8 claims and N244 applications.
· Ensure the litigation process is carried out in line with statute, best practices, and the firm’s standards.
· Maintaining high levels of client care throughout. Requirements Experience: Minimum 2 years’ litigation experience. Skills & competencies:
· Housing disrepair experience is desirable, but not essential. Position would also suit those from a personal injury background.
· Ability to handle volume work.
· Experience of Proclaim or other case management software is desirable, but not essential.
· Competent in use of Microsoft packages such as Word, Teams.
· Excellent communication skills – verbal and written.
· Ability to make decisions.
· Ability to problem solve.
