Responsibilities
  • The core duty is to assess whether a deprivation of liberty is occurring or is likely to occur, and to determine if it is necessary and proportionate.
  • BIAs must integrate their knowledge of the MCA to understand if the person lacks the capacity to make the relevant decision.
  • A primary focus is to decide if the proposed deprivation of liberty is in the person\'s best interests.
  • This involves meeting the person being assessed, reviewing their needs, wishes, and strengths, and consulting with relevant people such as family members and other professionals.
  • The role requires a deep understanding and integration of the legal framework surrounding the MCA and DoLS.
  • BIAs must synthesize complex information to make professional, independent, and ethical decisions based on evidence and differing views.
  • They are responsible for producing detailed reports that document their findings, assessments, and recommendations.
  • BIAs make recommendations to reduce the need for deprivation of liberty or to lessen its impact on the individual.
  • Keeping detailed and accurate records of their assessments and decisions is a crucial aspect of the role.
Requirements
  • Must be a Qualified Social Worker, registered with Social Work England.
  • Must have a Social Work qualification (Diploma in social work, social work degree or equivalent)
  • Must have minimum of 3 years Post Qualifying experience working as a social worker
