Job description

Reporting to the General Counsel, the Real Estate Law Clerk provides legal and administrative support across the company's residential, commercial, and corporate operations. The role supports a broad range of legal matters, including acquisitions and dispositions, commercial and residential leasing, financing transactions, corporate governance, contract administration, and general legal affairs.

Working closely with internal departments and external legal counsel, the Real Estate Law Clerk assists in coordinating legal documentation, maintaining corporate records, supporting transaction closings, and ensuring legal matters are completed accurately and on schedule.

Key Responsibilities
  • Assist with acquisitions, dispositions, and development transactions.
  • Coordinate transaction documentation, due diligence, and closing requirements.
  • Review and organize title, survey, and other property-related documentation.
  • Liaise with external legal counsel, lenders, and consultants.
Commercial & Residential Leasing
  • Prepare and coordinate leases, lease amendments, renewals, assignments, notices, and related leasing documentation.
  • Maintain lease abstracts and monitor key lease dates.
  • Support Property Management with leasing-related legal matters.
  • Assist with construction financing, refinancing, and lending transactions.
  • Coordinate legal documentation and satisfy lender closing requirements.
  • Maintain financing files and related documentation.
Corporate Governance
  • Maintain corporate records and minute books.
  • Prepare corporate resolutions and annual filings.
  • Support incorporations, reorganizations, and other corporate matters.
Contract Administration
  • Assist with the preparation, review, execution, and management of a variety of legal agreements, including consultant, construction, service, confidentiality, property management, and development agreements.
  • Maintain legal templates and executed agreements.
Legal Administration
  • Organize legal files and document management systems.
  • Coordinate document execution through electronic signature platforms.
  • Track legal matters, key dates, and deadlines.
  • Prepare legal correspondence and administrative documentation.
Cross-Functional Support
  • Work collaboratively with Finance, Development, Construction, Sales, Property Management, and external legal counsel to support ongoing business operations.
  • Provide legal and administrative support on special projects and other matters as required.
HCRA Compliance & Licensing
  • Maintain and renew builder/vendor licences with the Home Construction Regulatory Authority (HCRA) by tracking expiry dates and proactively managing renewals ahead of deadlines.
  • Update and distribute company licence master lists across internal systems, office locations, and the sales department.
  • Coordinate and apply for new project registrations with the HCRA
  • Ensure the builder adheres to all HCRA rules, licensing conditions, and obligations under the New Home Construction Licensing Act at all times
  • Monitor HCRA communications, email blasts, and regulatory updates; communicate relevant changes internally and implement updated processes or forms across applicable departments (e.g., forwarding new regulatory forms to sales for inclusion in Agreements of Purchase and Sale)
  • Prepare responses to HCRA inquiries within required deadlines
  • Ensure all required documentation is complete, accurate, and filed in accordance with the company's directory structure
  • Process related invoices in a timely manner
  • Attend online or in-person HCRA webinars and information sessions as required to support company operations and maintain regulatory awareness
Tarion Warranty Administration
  • Obtain project information from construction and relevant departments to apply for Qualification for Enrolment (QFE) on BuilderLink; proactively follow up to allow sufficient time for approval prior to sales launches and construction commencement
  • Apply for Tarion QFE in a timely manner and ensure enrolment confirmation is received prior to construction commencement, in compliance with Tarion's requirements under the ONHWPA
  • Submit and process project enrolment details and related invoices through the BuilderLink portal
  • Prepare, track, and distribute weekly Construction Start Notices to applicable parties
  • Prepare and distribute the monthly 90 Days List to site supervisors and the Revaluation List of closing dates upon request
  • Generate and distribute Tarion Warranty Information Sheets (WIS) to the sales department for new project launches and upon APS terminations
  • Upload purchaser information to BuilderLink on a monthly basis, ensuring accuracy and completeness
  • Prepare and produce accurate notices to purchasers in compliance with Tarion guidelines and Ontario regulatory requirements
  • File extension notices in APS folders and update Delayed Occupancy/Closing extension dates in BuilderLink
  • Track, review, and process Delayed Closing Compensation Claims under the Ontario New Home Warranties Plan Act; upload responses to BuilderLink and mail responses to homeowners in accordance with prescribed timelines
  • Manage Condition Precedent (CCP) creation, updates, and close-outs as directed; respond to all CCP-related inquiries under the Warranty section of BuilderLink
  • Respond to all Tarion inquiries with a high level of professionalism to maintain positive standing with all Tarion departments
  • Monitor Tarion regulatory updates, new forms, and process changes; communicate updates to relevant departments and implement new workflows as necessary (e.g., sharing new Warranty Forms or updated fee schedules with Accounting)
Qualifications
  • Law Clerk Diploma or equivalent legal education.
  • 3-7 years of experience in commercial real estate law, preferably in-house or at a law firm.
  • Experience supporting commercial leasing, real estate transactions, financing, and corporate matters.
  • Familiarity with Ontario real estate and corporate law practices.
  • Proficiency in Microsoft Office and legal document management systems; experience with Teraview or similar software is an asset.
  • Strong organizational, communication, and time management skills with exceptional attention to detail.
  • Ability to manage multiple priorities while maintaining a high level of accuracy and confidentiality.

Salary Range: $75,000 - $100,000
