Hearing Officer - Administrative Monetary Penalty System

Three opportunities are available with the City of Markham for Hearing Officers to hear matters related to the City’s Parking Control By-law, approximately 2-3 days per month on an as-needed basis. Please submit your cover letter and resume online by May 15, 2025.

As a Council-appointed Hearing Officer (per Ontario Regulation 333/07), you will review decisions made by Screening Officers regarding municipal by-law penalties under the City’s Administrative Monetary Penalty System (AMPS). You should be familiar with municipal law and adjudicative processes, as you will determine whether to affirm, vary, or cancel (on appeal) penalty decisions. While the initial focus is on parking offences, the scope may expand to other offences under City By-laws in the future. Your duties include:

  1. Making rulings and issuing oral and written decisions related to the AMPS By-law independently and impartially;
  2. Deciding whether to vary administrative penalty amounts and/or the time to pay penalties, in accordance with the AMPS By-law and policies;
  3. Conducting hearings in accordance with the Statutory Powers Procedure Act, ensuring fairness and due process for all parties.

All decisions are final and binding. Hearings may be conducted in person or virtually. Appointments are made by City Council for a term of approximately 4 years, with invoicing on a minimum monthly basis. Members of Council, their relatives, and persons indebted to the City are ineligible to apply.

Qualifications:

  • Preferably, membership in The Society of Ontario Adjudicators and Regulators (SOAR) and/or The Law Society of Ontario (LSO);
  • Cannot act as an agent before the Administrative Monetary Penalty Tribunal or other City tribunals;
  • Post-secondary diploma or degree in a related field, or equivalent experience;
  • Experience with adjudicative processes, including hearings for tribunals or courts;
  • Knowledge of relevant legislation, including Municipal By-laws, Municipal Act, Provincial Offences Act, and the Statutory Powers Procedure Act;
  • Understanding of access to information and privacy legislation;
  • Knowledge of City parking By-laws;
  • Experience in mediation and dispute resolution;
  • Strong leadership, facilitation, communication, and organizational skills;
  • Commitment to access to justice, diversity, and accommodation;
  • Ability to communicate decisions clearly in writing and orally;
  • Leadership and administrative skills;
  • Willingness for ongoing professional development;
  • Computer literacy;
  • Availability to provide services part-time (about 2-3 days per month), with schedules determined collaboratively.

    This part-time position offers a salary of $400 per day plus mileage expenses.
