The Expert in Bodily Injury and Litigation is responsible for handling liability claims for bodily injuries in Quebec and the USA. This includes thorough investigations into liability and damages, regular interaction with claimants and defense attorneys, and potential travel.
Conduct prompt and comprehensive investigations into civil liability, injuries, and related damages, leading to logical conclusions. Investigations may be conducted jointly with an independent claims expert acting as a reviewer.
Establish and maintain adequate reserves following established protocols; adhere to protocols for major claims reporting, notification, and settlement authorizations.
Gather and document relevant information clearly and concisely, respecting protocols to ensure accuracy and quality of information.
Proactively manage litigated indemnity files, adhering to established guidelines.
Manage potential indemnities and costs to ensure sound cost management practices.
Exercise sound judgment in evaluating and resolving valid claims, considering all available information and guidelines.
Communicate promptly with claimants to build trust and collaboration, resolving claims within a reasonable timeframe and following a fair and proactive process.
Manage claimant expectations, maintain regular follow-up, and meet commitments to resolve claims quickly and fairly.
Engage with all parties, including judicial experts, regarding their roles, rights, and responsibilities, to ensure collaboration.
Build trust and maintain professional relationships with claimant attorneys to facilitate timely and fair settlements.
Proactively collaborate with defense attorneys according to established practices.
Complete all necessary reports promptly.
Attend settlement meetings, mediation sessions, and trials outside the office as needed.
The role may require working irregular hours based on activity schedules and key events.
Minimum 5 years of experience as a claims expert, with bodily injury experience or related litigation experience considered an asset.
Knowledge of current civil procedure rules.
Deep understanding of the insurance sector and related legal context.
Ability to prioritize and handle all activities related to claim processing, considering client, third-party, witness, healthcare professional, law enforcement, and expert availability.
