Job description

Position: Investigations Manager and General Counsel

Posting Close Date: Open until filled

Location: Whitehorse, Yukon (onsite in office)

Job type: Permanent full-time

Salary range: $111,735 to $153,449 per annum + legal stipend

Benefits: Extended health benefits and 12% in lieu of pension

Workdays/hours: Monday to Friday from 8:30 AM to 4:30 PM (7.5 hrs/day)

Travel bonus: $2,242.00 per year (after 2 years of employment)

  • Applicants must be legally able to work in Canada.

The Office of the Ombudsman, Information and Privacy Commissioner (IPC), and Public Interest Disclosure Commissioner (PIDC) is seeking to fill the position of Investigations Manager and General Counsel on its Formal Investigation (FI) team.

The Ombudsman, IPC, and PIDC is an independent officer of the Yukon Legislative Assembly with responsibilities under several Acts, including the Ombudsman Act, the Access to Information and Protection of Privacy Act (ATIPPA), the Health Information Privacy and Management Act (HIPMA), and the Public Interest Disclosure of Wrongdoing Act (PIDWA). The role involves investigating allegations of unfairness, ensuring compliance with privacy laws, managing legal matters, and providing guidance and oversight within the Office.

Responsibilities:
Investigations Manager functions:
  1. Conduct investigations under relevant Acts, including exercising powers to summon persons, examine evidence, and enter premises.
  2. Write reports following investigations, including findings and recommendations.
  3. Provide legal advice to public organizations.
  4. Perform compliance reviews and audits.
  5. Evaluate privacy breaches and impact assessments, providing mitigation recommendations.
  6. Review and approve information sharing agreements.
  7. Review and decide on extension requests for access processing.
  8. Ensure recommendations are implemented.
  9. Perform duties of Acting Registrar of Adjudications when necessary.
  10. Comment on policies and develop guidance materials.
  11. Educate the public and organizations about relevant Acts.
  12. Consult with organizations and individuals across Canada.
General Counsel functions:
  1. Uphold professional legal standards and follow policies.
  2. Provide legal advice and propose solutions related to the Office's responsibilities.
  3. Keep staff informed about relevant legal issues and draft policies and notices.
  4. Review and draft legal documents.
  5. Manage litigation processes and coordinate with outside counsel.
  6. Ensure legal compliance and credibility of the Office.
  7. Liaise with legal counsel and senior officials.
  8. Supervise legal work of investigators and outside counsel.
  9. Supervise articling students and interns.

It is highly desirable for candidates to have:

  • CIPP/C certification
  • Experience investigating causes of privacy breaches, interpreting legislation, and managing privacy issues involving information systems.
