Job Purpose
Represents the Law Society in court proceedings, including appearances before the Ontario Superior Court of Justice, Divisional Court, and Ontario Court of Appeal. Provides legal support to all working groups within Regulatory Services, including obtaining court-ordered trusteeships (Litigation), overseeing the winding up of law practices, and making recommendations for grants to the Compensation Fund. Responsibilities also include analyzing, monitoring, and enforcing orders issued by the Law Society Tribunal and the courts, enforcing cost orders, monitoring licensee undertakings, and managing assignments and judgments related to the Compensation Fund.

Qualifications
  • Requires an LLB or J.D. and a class L1 license in good standing with the Law Society of Ontario.
  • A minimum of 7 years of experience in litigation is required.
  • Must hold a valid “G” class driver’s license.
  • Requires an understanding of the Law Society’s mandate, services, legislation and policies.
  • Knowledge of the rules of evidence, rules of procedure, and law concerning privilege and documentary disclosure.
  • Advocacy skills for formal court proceedings.
  • Legal research skills.
  • Ability to communicate clearly and persuasively in both spoken and written language.
  • Proficiency in Microsoft Office Suite / 365 (Word, Excel, PowerPoint, etc.).
  • MS Dynamics experience is an asset.
  • Application consent to a regulatory history check with the Law Society.

Key Accountabilities
Client / Customer Service Planning
  • Develop strategies for court proceedings, assessing legal action necessity, involved parties, service requirements, risks, and effective approaches.
  • Review and understand information in undertakings, judgments, court orders, and licensee details.
  • Design and refine standard terms for undertakings and orders, and develop templates for Regulatory Compliance.
  • Lead logistical efforts for winding up legal practices, including coordinating with third-party providers and police for safety.
  • Oversee collection and enforcement of orders from Law Society decisions and court judgments.
  • Review medical reports and capacity-related information, developing strategies with the Office of the ED.
Client / Customer Service Delivery
  • Conduct court proceedings and enforce orders of the Law Society Tribunal and courts.
  • Represent the Law Society in proceedings related to freeze orders, trusteeships, bankruptcy, and enforcement activities.
  • Administer trusteeships and custodianships, negotiate arrangements, pursue collections, and evaluate claims to the Compensation Fund.
  • Manage files related to enforcement, including filing writs, conducting examinations, and monitoring compliance.
  • Conduct interviews and serve as a witness in proceedings if required.
Practice Recovery
  • Participate in winding up professional businesses and ensuring client property protection.
  • Assist in administering trusteeships, reviewing client files, and distributing recovered funds.
Regulatory Compliance
  • Monitor and enforce orders, participate in enforcement activities, and ensure compliance with regulations.
Compensation Fund
  • Review licensee records for financial discrepancies and allegations, gather evidence, and facilitate claim dispositions.
  • Prepare memoranda and meet with stakeholders to clarify requests.
  • Monitor payments and financial obligations related to judgments and orders.
Policy Development
  • Establish procedures for file collection, participate in policy development, and recommend policy changes.
Team Membership
  • Provide guidance to support staff, coordinate with other departments, and improve processes.
