What Is the Opportunity?
Under moderate supervision, fulfill the Specialty Insurance Claims mission by providing coverage opinions, conducting thorough investigation, analysis, evaluation, and disposition of claims to achieve superior customer service and claim results at the most reasonable cost. Effectively manage all assigned Specialty claims, typically of moderate severity or complexity. Interact with, collaborate with, and provide legal advice and transactional support to claim and underwriting colleagues.
What Will You Do?
- Claim Handling:
- Analyze, investigate, negotiate, and resolve moderate severity Specialty claims within authority limits with moderate supervision by claims management.
- Identify recovery opportunities and coordinate recovery efforts with the Recovery Management Unit and claims management.
- Prepare reports (e.g., Large Loss Memos, quarterly claim, EC, trial, class action) reflecting loss development, financial exposure, coverage issues, and strategies.
- Manage and approve payments to outside counsel on routine litigation matters within authority limits, seeking guidance for non-routine litigation.
- Make decisions within claim authority and recommend to management when necessary.
- Follow operational policies, including compliance, regulatory, and customer service standards.
- Maintain accurate documentation in claim files and management systems, adhering to documentation standards.
- Seek management input for claims beyond authority and communicate reserve adjustments to underwriting.
- Mentor less experienced colleagues in claim resolutions.
- Lead or participate in claim strategic initiatives.
- Legal Support:
- Conduct coverage analysis and provide opinions.
- Answer legal questions impacting underwriting decisions, using legal research and experience.
- Advise underwriters on policy language and coverage.
- Support non-lawyer claim professionals with legal standards and advice.
- Maintain active legal license and continuing education.
- Specialty Claim Specific:
- Interpret policies and draft coverage opinions with case law.
- Contribute to review and revision of new products, policies, and endorsements.
- Transactional Work and Negotiation:
- Draft and review coverage and reservation of rights letters.
- Draft releases and settlement agreements, advising clients and claim professionals.
- Negotiate settlements directly or via counsel, using relevant legal arguments.
- Perform other duties as assigned.
What Will Our Ideal Candidate Have?
- Prior experience in the Specialty insurance industry preferred.
- 4+ years as a lawyer (including in-house) or claims handling experience preferred.
- Strong negotiation skills in litigation and non-litigation contexts.
- Effective communication skills, both written and oral.
- Ability to communicate legal advice independently or with management input.
- Proficiency in drafting transactional documents.
- Professional demeanor in conflict resolution.
What is a Must Have?
- Bachelor’s degree required.
- Juris Doctorate outside Quebec or Bachelor of Civil Law in Quebec.
- Qualified legal practitioner in the relevant province.
- Minimum 3 years legal or claims handling experience.
