Senior Legal Counsel – Latin America
We are seeking a Senior Legal Counsel in Latin America whose key responsibility is to serve as a legal advisor and business partner to the General Managers (GM) of Brazil, LATAM and Mexico & Central America and the members of their Leadership Team. The Senior Counsel will provide legal expertise in contracts, employment law, and other ad-hoc support in Latin America, as well as in other markets, depending on workload capacity in Latin America. The ideal candidate will have prior experience counseling prescription pharmaceutical companies in Latin America, specifically advising prescription drug companies on legal issues related to the launch and commercialization of new pharmaceutical products, as well as matters concerning marketing, promotion, advertising, scientific exchange, interactions with healthcare professionals and employment law within the LATAM region.
The position requires native-level proficiency and/or fluency in Portuguese, Spanish and English.
Essential Functions
- Attend and actively contribute to discussions and decisions at the affiliates Leadership Team meetings, providing sound and highly responsive legal and business partner support.
- Act as a subject matter expert on Latin America healthcare laws and related business operations, staying abreast of evolving local healthcare legislation and regulations.
- Advise business colleagues on various initiatives to advance the Company’s strategy while addressing legal risks and protecting BeOne’s integrity and reputation.
- Provide local and regional legal advice on promotion, market access, pricing and reimbursement, employment, the use of social media, dissemination of scientific information, product liability, competition, and other matters relevant to the development, regulatory approval, and commercialization of prescription drugs.
- Serve as a “wise counsel,” offering good judgment and practical legal solutions to challenges faced by BeOne in Latin America, maintaining a thoughtful risk-taking mindset in all areas of the Life Sciences industry.
- Draft, negotiate, and manage a high volume and wide variety of complex contracts. This includes the review and revise employment agreements, consulting agreements, and HR-related contracts.
- Develop local policies, procedures, and processes for Latin America adapted from global SOPs that ensure compliance with local laws, regulations, and codes while driving consistency. Conduct training as needed.
- Build relationships and influence at all organizational levels, demonstrating a flexible approach to connect with colleagues across the broader organization and engage with multiple stakeholders to drive projects and cultural change.
- Provide practical, solution-oriented legal support to BeOne internal clients during contract preparation and negotiation. Train and educate local and regional stakeholders on the use of contract templates, relevant legal issues, and best contracting practices.
- Manage external counsel effectively, build effective relationships, and monitor legal spending.
- Exhibit excellent verbal and written communication skills, developing and providing clear direction to the business and pragmatic solutions to complex legal and compliance challenges.
- Demonstrate sound judgment and self-confidence to identify, assess, and mitigate legal and compliance risks, delivering effective recommendations on diverse legal and business matters.
- Generate reports, presentations, spreadsheets, memos, and other documents for the Legal and Compliance Department, internal/external clients, and the senior management team as requested.
- Complete special projects and responsibilities as requested in Europe and the New Markets regionli>
- Provide expert legal guidance on employment matters, including hiring, terminations, compensation/benefits, union relations, contingent workers, safety and health requirements, performance management, internal investigations, and leave of absences across various LATAM countries. Advise and implement proactive strategies for labor risk prevention and compliance with local labor codes.
- Handle and resolve disputes and claims including pre-litigation and litigation disputes and government audits. Assist in internal investigations related to employment issues.
- Monitor pending and new laws, regulations, decisions and government enforcement activities, also in those related to employment issues, and provide proactive, strategic advice to relevant stakeholders.
- Conduct periodic meetings or “office hours” for HR/Payroll to meet with internal and external counsel, as needed, to resolve HR issues more effectively and efficiently. Work closely with the Assistant General Counsel, Americas Employment, who will be a supportive, advisory manager, to allow collaborative oversight on employment-related issues.
Minimum Requirements – Education and Experience
- Brazilian law degree, with strong experience in advising on Brazilian laws governing pharmaceutical companies.
- 7+ years of experience, preferably including both in a law firm and in-house in the biopharmaceutical industry.
Other Experience
- Native-level fluency or fluency in Portuguese, Spanish and English required. Additional European language skills are an advantage.
- Experience advising on and strong and up to date knowledge of Latin America medicines/biopharmaceutical laws, regulations, codes of practice and best practices.
- Demonstrated experience gained within the pharmaceutical or biotechnology industry and/or significant law firm experience advising clients within the life sciences sector, including with the launch of new pharmaceutical products.
- A demonstrated ability to collaborate, as well as to work independently, balancing competing priorities in a fast-paced, deadline-driven environment with a high level of professionalism.
- Highly effective communication skills (both verbal and written).
- Excellent drafting, negotiation, communication, analytical and problem-solving skills.
- Ability to meet deadlines and work across time zones.
- Detail-oriented.
- Ability to handle confidential and proprietary information using discretion and judgment.
- Self-motivated, able to work independently and be reliable and responsive.
- Ability to be flexible and willing to accept new responsibilities as needed.
