The role will mainly provide legal consultation in areas such as commercial law, sales and purchase transactions, procurement contracts, and various other legal issues under Brazilian law, particularly tax compliance, labor compliance, leasing, advertising compliance, and marketing regulations.
Reporting to the General Manager of South America and under the administrative management of the Legal Department of the Chinese headquarters.
Responsibilities
- Draft and review various commercial agreements, including sales/customer agreements, distribution and sales representative agreements, procurement agreements, licensing and development agreements, advertising endorsement agreements, etc.
- Handle various matters related to Brazil, including tax compliance, labor law compliance, corporate and lease contracts, dispute resolution, and other legal issues.
- Respond promptly to the requests of internal customers and prompt the business team about relevant legal risks.
- Coordinate with cross-functional teams, offer legal options/analyze potential legal solutions, and liaise with external legal counsel.
- Support the daily legal operations of the headquarters’ legal department, completing tasks related to corporate governance.
- Keep abreast of new laws, regulations and industry trends that affect the company, and assist in policy formulation and training as needed.
Qualifications
- Law Degree and certification to practice law in Brazil.
- Training and certification to practice law in other countries is not required but would be a big plus.
- 3-5 years' experience in legal practice (either in a large, international law firm or a combination of a large law firm and in-house experience).
- Fluency in Portuguese and English/Mandarin.
- Significant experience working as a commercial attorney and providing legal advice for multinational manufacturing company.
- Excellent organizational and planning skills and the ability to simultaneously handle a variety of complex matters under deadline.
- Strong demonstrated experience drafting and negotiating contracts.
- Excellent written, verbal and analytical skills and an ability to communicate complex issues in a simple way and to orchestrate plans to resolve issues and mitigate risks.
- Ability to form strong working relationships with other employees and business partners while maintaining firm adherence to proper legal standards.
- Sound business judgment and strategic thinking. A flexible and proactive mindset with genuine interest in understanding the legal implications of business strategy and providing actionable recommendations.
