FSMA is seeking a legal advisor to join the supervision of asset management and bank savings and investment products. You will handle approvals of prospectuses and ensure compliance of banking products with the Moratorium, while analyzing complex issues and drafting clear, concise guidance for stakeholders.

The role requires a Master’s in Law with a financial law focus and at least three years in the financial sector. Fluency in Dutch, French and English is expected.

Qualifications

• Master's degree in law; specialization in economic/financial law is an asset.
• At least three years of professional experience in the financial sector.
• Strong knowledge of general financial legislation and financial products; familiarity with structured products is an asset.
• Excellent written and oral communication skills; ability to present complex content clearly.
• Ability to work in a team and defend positions before interlocutors.
• Command of Dutch, French and English.

Responsabilités

• Handle applications for approval of prospectuses relating to banking products or derivatives.
• Supervise compliance of structured products with the FSMA Moratorium and check advertisements.
• Carry out thorough analyses of complex issues based on applicable laws and regulations.
• Participate in transversal projects and implement Belgian and European legislation on banking and alternative products (e.g. crypto assets).

WHERE WILL YOU BE WORKING?

Many consumers find financial products difficult to understand, or they do not take enough time to look closely into financial matters. As a result, they are often unaware of financial risks. Problems may therefore arise. The FSMA supervises financial products and takes initiatives to prevent problems and enhance consumer confidence in such products. Its supervision is intended to help ensure that the products offered are understandable, safe, useful and cost-transparent.

You will join the "Supervision of asset management and of bank savings and investment products" department and, in particular, the team that is responsible for supervising banking products such as savings accounts, structured products and alternative products.

WHAT IMPACT WILL YOU HAVE?

As a legal advisor:

• you will handle applications for approval of prospectuses relating to banking products or derivatives, ensuring the consistency of the FSMA's supervisory practices;
• you will supervise the compliance of structured financial products with the FSMA's Moratorium on the distribution of particularly complex structured products and you will check advertisements for those products;
• you will carry out a thorough analysis, based on applicable laws and regulations, of sometimes highly complex issues;
• you will participate in specific transversal projects and in the implementation of Belgian and European legislation on banking products and alternative products such as crypto assets.
• you will answer consumers' questions on banking products;
• you will work closely with colleagues from the department in charge of supervising public UCIs (or investment funds) and with colleagues from other departments, including those responsible for supervising compliance with conduct of business rules, perimeter supervision, and data analytics.

WHAT DO YOU BRING?

• A Master's degree in law. A specialization in economic and/or financial law is an asset.
• Preferably at least three years' professional experience in the financial sector.
• A good knowledge of general financial legislation and financial products. Familiarity with structured products is an asset.
• Strong analytical and organizational skills, and a capacity for synthesis.
• Excellent oral and written communication skills, with a strong interest in presenting complex content in clear and unambiguous terms.
• Interest in the challenges encountered in the world of finance (digitization, fintech, big data, etc.).
• Ability to maintain efficient and professional contacts with financial industry players and to defend positions before your interlocutors.
• Adaptability to new situations and strong interpersonal skills.
• Ability to work as a team and to take initiative.
• Solid competence in Dutch, French and English.
