Are you a sharp legal mind with a flair for commercial labour and contractual law Ready to make your mark in a dynamic multi-disciplinary environment We're seeking a seasoned Legal Advisor to join a leading professional services firm operating across the built environment. Position is based in Cape Town or Gauteng.
Duties and Responsibilities
- Providing general legal support to the different divisions of the company: Finance & Management Support / Management Programme / FCAs / Professional Services
- Drafting of legal documentation including contract templates, default notices, PSP appointment letters, etc. (e.g. Sub-consultant PROCSA and CIDB templates and Addenda)
- Vetting and compliance: All legal documentation drafted on behalf of third‑party funders
- Monitoring ongoing litigation and disputes, vetting court documentation where applicable
- Client liaison
- Attorney liaison
- Liaising with employers and/or consultants on legal matters on behalf of the Company and/or clients
- Attending to registration of securities, signing of irrevocable payment undertakings and perfecting of securities
- Attending to legal correspondence with all relevant stakeholders including employers, clients and third parties
- Assisting with special tasks on an ad‑hoc basis
- Assisting in monitoring legal risk & compliance
- Ensuring that all suspensive conditions are met prior to clearance being given (FMS)
- Ensuring that all contract documents are correctly executed
- Attending to recoveries and debt collection
- Drafting of LOD/AOD and monitoring repayments for debt collection on behalf of the Company
- Setting and meeting collection targets as per agreement with the Company
- Attending debt collection meetings
- Instructing external attorneys per requirement
- Attorney liaison and responding to queries and requests for information
- Assisting with trial preparation, documentary evidence, briefing of witnesses, etc.
- Reporting on legal matters
- Drafting of meeting minutes and submitting reports to the Legal Manager as required
- Attending to in-house HR administrative matters
- Assisting with disciplinary matters (e.g. drafting charge sheets, records, outcomes)
- CCMA: Attendance of hearings, hearing preparation & trial bundles
- Redrafting of Company HR policies, monitoring input from internal and external stakeholders, and driving to completion
- Monitoring performance gradings and providing guidance to the relevant Executive
Requirements
- LLB
- Admitted attorney (Admitted Conveyancer will be advantageous)
- At least 5 years of relevant post‑qualified experience
- Labour: contracts / CCMA / disciplinaries
- Litigation / court processes
- Legal recoveries, including exposure to liquidation processes and Business Rescue
- Basic knowledge of contract law interpretation, drafting and vetting
- Advantageous knowledge of the built environment and the following standard building contracts:
- JBCC 6.2
- GCC (2015)
- NEC3 / NEC4 suite of agreements
- Experience in policy review
