Job summary

Texas Health and Human Services Commission (HHSC) is seeking a Litigation Attorney IV for the Medicaid Litigation Team in Austin. The role provides legal advice and representation for Medicaid-related litigation and defends the agency against civil actions.

The attorney will manage litigation preparation, settlement negotiations, and appellate activities as part of a senior team. Licensing in Texas and a JD/LLB with at least three years of litigation experience are required.

Qualifications

  • J.D. or LL.B from an accredited law school.
  • Licensed to practice in Texas and in good standing.
  • Minimum of 3 years of litigation experience.

Responsibilities

  • Draft summaries of new litigation, identify parties and claims, defenses, and evaluate risks. Provide timely updates to leadership. (30%)
  • Draft letters to the OAG, respond to complaints and petitions, research claims and defenses, ensure motions filed timely, draft/ review briefs and motions. (20%)
  • Review discovery requests, draft or review discovery responses & objections, use e‑discovery software, ensure productive discovery. (20%)
  • Review settlement recommendations, draft settlement documents, participate in negotiations, ensure compliance with court orders. (20%)
  • Draft appellate review recommendations, appellate briefs and arguments, ensure appeals filed timely. (10%)

Job Summary

Litigation Attorney IV – Litigation Department, Medicaid Litigation Team – Texas Health and Human Services Commission (HHSC). The role provides legal advice and representation for litigation involving Medicaid, defends the agency against civil actions, and conducts litigation preparation and settlement negotiations.

Essential Job Functions
  • Draft summaries of new litigation, identify parties and claims, defenses, and evaluate risks. Provide timely updates to leadership. (30%)
  • Draft letters to the OAG, respond to complaints and petitions, research claims and defenses, ensure motions filed timely, draft/ review briefs and motions. (20%)

Knowledge, Skills and Abilities
  • Knowledge of federal and state rules of civil evidence and procedure.
  • Researching, reviewing, analyzing, interpreting, and applying federal and state laws, rules, and regulations.
  • Writing, communicating, and solving complex problems using reasoning and logic.
  • Hearing, deposition, and trial preparation.
  • Proficiency with agency computers and software platforms, legal research, summarizing findings, effective communication, prioritizing workload, good judgment.
Registrations, Licensure Requirements or Certifications
  • Must be licensed as an attorney in Texas and a member in good standing of the State Bar of Texas.
Initial Screening Criteria
  • Graduation from an accredited law school with an LLB or JD.
  • Minimum of 3 years of litigation experience.
