Experienced and knowledgeable attorney with in-depth knowledge of a broad range of state energy regulatory policy issues. Substantial state utility commission, energy policy, and renewable energy experience preferred, with a preference for litigation and oral advocacy experience. Will be responsible for providing legal guidance requiring independent judgment and frequent client contact. Provide high-quality and timely legal advice and counsel in support of the business unit or legal practice for all utility matters, with a special emphasis on integrated resource planning. Attorney also assigned responsibility for routine legal matters including, but not limited to, ratemaking, PURPA policy issues, prudence determinations, affiliate issues, and other issues germane to an investor-owned regulated utility. Develop relationships with clients to ensure effective communication and responsiveness. Demonstrate responsiveness and teamwork within the legal department.

Associate General Counsel - NC Regulatory works under the direction of a Deputy General Counsel on defined legal problems or legal problems lacking clear precedent that require the application of specialized expertise and business acumen. The incumbent’s primary duties will be to work on administrative litigation matters in North Carolina concerning general energy policy issues and to otherwise address legal and regulatory problems and concerns arising out of the day-to-day functions of Duke Energy. Works on non-routine matters that require a broad and thorough understanding of Duke Energy’s business and industry.

• Perform complex assignments, using legal research, analytical and writing skills, involving both state and federal law


• Provide legal advice to management regarding matters of some complexity which may have a material dollar impact on business operations


• Research legal principles and precedents, consult with outside counsel, draft and execute legal documents, and gather relevant case information using multiple sources and methods


• Handle administrative litigation matters and conduct hearings, including presentation of witnesses and cross-examination


• Coordinates and collaborates on regulatory matters that have various areas of overlap within the business


• Provide advice and counsel on compliance matters relevant to regulatory matters


• Oversee and manage routine regulatory reporting and compliance filings

Responsibilities

• Provide counsel to electric management and represent Duke Energy in administrative litigation in regulatory proceedings involving renewable energy matters, pricing, rates, customer service matters, transmission, distribution and generation planning, fuel procurement and system operations, tariffs, territorial assignments, compliance matters, regulatory accounting, and other federal and state law compliance matters that require quick study and a desire to expand existing knowledge in the regulated energy industry.


• Responsible for regulatory proceedings, the defense or prosecution of appellate cases as assigned, and rulemakings or interventions in related matters.


• Support key stakeholder engagement initiatives for the benefit of Duke Energy and its customers.


• Represent Duke Energy in regulatory matters requiring specialized expertise in state regulatory proceedings and a thorough understanding of the regulatory concerns facing Duke Energy to negotiate the best possible outcomes for Duke Energy’s business and its customers.

Working Conditions

• Must live in Raleigh/Durham/Chapel Hill area.


• Ability to travel interstate to key conferences at various locations in the U.S. two to three times per year

Required/Basic Qualifications

• Doctor of Jurisprudence degree (JD) from an accredited law school


• Minimum of seven (7) or more years of experience practicing law


• Licensed to practice law in North Carolina, or licensed to practice in any state in the U.S. and eligible for admission under North Carolina bar rules

Preferred Qualifications

• North Carolina regulatory/agency experience


• Litigation experience


• Understanding of emerging energy issues


• Experience interacting with multiple stakeholders and collaborative groups to reach multi-party resolutions


• Demonstrated ability to work independently and collaboratively under deadline pressure, including in fast-moving, high-stakes matters


• Proficient oral and written communication skills


• Broad, in-depth knowledge and experience in the energy industry


• Knowledge of Duke Energy and its various business operations


• Proven communication and interpersonal skills


• Sound judgment, strategic thinking, and decision-making skills, including the ability to make decisions under pressure


• Ability to collaborate as an effective member of the team


• Excellent work product and attention to detail


• Proven effective legal research and writing skills


• Ability to hit the ground running
