Base pay range

$115,283.00/yr - $145,682.00/yr

Responsibilities
  • Coordinate all phases of the investigation and referral of suspected criminal tax fraud cases to ensure successful prosecution.
  • In cooperation with audit and investigations staff, assist in determining case selection and planning audit & investigation strategies.
  • Ensure evidence gathered is admissible in court and that taxpayers’ and witnesses’ constitutional rights are not violated.
  • Render advice on current or proposed investigation and audit techniques.
  • Assist in development of state-wide projects to detect criminal tax fraud.
  • Assist staff in developing strategies to obtain records from taxpayers, corporations, or their legal representatives.
  • Gather evidence for referral of cases to prosecutorial agencies.
  • Assist in drafting accusatory instruments and search warrant applications.
  • Prepare detailed case reports.
  • Maintain contact with NYS Attorney General’s office, local district attorneys, and U.S. Attorney’s office on cases slated for prosecution.
  • Supply additional information as needed.
  • Prepare auditors & investigators to act as expert witnesses.
  • Track disposition of referred cases.
  • Meet with prosecuting attorneys as necessary to assist prosecution of cases.
  • When requested, become cross-designated as assistant district attorneys.
  • Recommend changes in policies, procedures, or legislation based on research and court decisions.
  • Provide legal assistance to staff of other Department programs regarding tax fraud investigations or other CID programs.
  • Work with Office of Counsel to assist in providing legal advice to non-CID employees located within the District Office.
  • Perform other related duties as required.
  • Adhere to the Department’s time and attendance rules.
Qualifications
  • Admission to the New York State Bar.
  • Three years of post-Bar experience as an attorney, with at least one year involving defense or prosecution of crime.
  • Telecommuting possible; hours to be discussed.
