ASSISTANT PUBLIC DEFENDER (2nd): WYOMING COUNTY PUBLIC DEFENDER

HOURS: Primarily Day Shift SALARY: $93,730 - $110,863 per year/Full Time

LOCATION: Wyoming County Public Defender, 18 Linwood Avenue, Warsaw, New York 14569

DISTINGUISHING FEATURES OF THE CLASS:

This is professional legal work of a complex nature which involves legal and trial work in the representation of indigent defendants in criminal and family court matters. The work includes primary responsibility for representation in Wyoming County Family Court, as well as maintaining an assigned criminal court caseload in Wyoming County Court and local Town and Village Courts. Wyoming County Family Court proceedings include neglect, abuse, custody, visitation, family offense, support, juvenile delinquency, and related matters. Family Court involves representing petitioners or respondents through all stages of proceedings following assignment of the family court petitions through to the conclusion of the matter. Work is performed under the general supervision of the Public Defender with wide leeway for the exercise of independent judgment. Does related work as required. Represents defendants at Counsel at First Appearance (CAFA), pursuant to off-hours CAFA rotation, as assigned.

MINIMUM QUALIFICATIONS:
  1. 1. Graduation from a regionally accredited Law School or one accredited by the New York State Board of Regents to grant degrees with a Juris Doctorate;
  2. 2. Admission to the NYSBAR or has admission pending;
  3. 3. Full time in-person appearances;
  4. 4. Reliable transportation and license to operate a motor vehicle in New York State;
  5. 5. Experience as an attorney in criminal law and/or family law, and/or AFC preferred;

Ability to: Understand, interpret, and apply all statutory laws related to practicing criminal law and family law in New York State, including the CPLR, Family Court Act, Domestic Relations Law, Social Services Law, Penal Law, Criminal Procedure Law, Corrections Law, Executive Law 259-I and Judiciary Law; trial and appellate court procedures; legal research methods; rules of evidence; standard legal office practice and procedures; and rules of ethical and professional conduct. Work independently; perform legal research; analyze and apply legal principles, facts, evidence and precedents in legal problems; present statements of law, facts and arguments clearly, logically and forcefully; both in written and oral format; maintain confidentiality and objectivity. Manage assigned caseload; operate personal computer and computer applications used by the units; establish and maintain effective working relationships with those encountered in the course of work; communicate with and advise clients in accordance with the laws and facts; and interact well with the public and court personnel.
