Job description

Advise on the resolution of contract disputes under various dispute resolution processes, including mediation, arbitration, tribunal hearings and court litigation.

Manage litigation files, including reviewing and compiling documentations such as letter of demand, pleadings, affidavits and submissions, tracking deadlines, and coordinating and communicating responses with internal teams and external counsel.

Maintain up-to-date litigation status reports and provide regular updates to management.

Maintain proper records and organize legal documentation for litigation and recovery cases.

Assist in contract management and dispute management, including reviewing contractual claims submitted by third parties and responding to such claims, identifying risks, strategizing legal positions, negotiating settlements and collaborating with internal team to protect the interest of the Group in any disputes involving clients, subcontractors, or third parties.

Manage employee disputes and represent the Group before government ministries, departments, and courts involving employment issues and disputes.

Conduct legal research on applicable laws and regulations, cases and updates.

Conduct legal training on relevant topics.

Perform any other duties as and when assigned from time to time.

Contracts & Corporate / Commercial

Draft, review, negotiate and advise on various corporate and commercial contracts involving the Group, including procurement contracts, service agreements, dealership agreements, distribution agreements, licensing agreements, joint venture agreements, shareholders agreements, land acquisition agreements, leasing agreements, share sale agreements and loan agreements.

Draft, review, negotiate and advise on construction-related agreements (e.g., construction contracts, supply contracts, letters of award, tender documents, warranties, guarantees and bonds).

Develop and maintain an updated depository of contract templates to improve efficiency and consistency across the Group.

Assist in managing the Group’s Intellectual Property Rights portfolio, including trademark applications, renewals, register maintenance, third-party consent, and defending infringements.

Conduct legal research on relevant laws, cases and updates.

Advise on compliance requirements and new legislation affecting the Group’s operations.

Conduct legal training on relevant topics.

Requirements

Called to the Malaysian Bar, with 3 to 7 years post-qualification experience (PQE) gained in legal practice and/or in-house position.

Proven experience in managing litigation, dispute resolutions and contentious matters related to construction, procurement and various operational aspects of the Group’s business.

Proven experience in drafting and negotiating contracts and transactional documents across construction, real estate, corporate and commercial sectors.

Sound knowledge of construction laws and debt recovery process.

Strong legal judgment and risk assessment capabilities.

Strong analytical and drafting skills.

Excellent written and oral communication skills.
